Full Version: faxed I-129F Expedite Request this morning

USCIS made an error back in march so I figured to request for an expedite.

I am not expecting anything, but if you don't shoot you'll always miss...

I’m currently in the US Air Force based in Germany. I’m due to return to the U.S. in Oct 07. My fiancé and I currently live together at my residence in Germany.

I originally applied for an I-129F in Mar 07. The California service center denied my application saying that because my current location was overseas, I must submit my application to the nearest American Embassy. I then contacted the US Embassy in Frankfurt Germany and was informed they do not process I-129F Visa’s.

After numerous phone calls and emails to the US Embassy, US State Dept. and USCIS, (which weren’t very helpful) I was advised to re-file my application and use a stateside address on the petition. I did so in Jun 07. A few weeks later, I finally received notice that my application was received and being processed.

Clearly the I-129F application refers to U.S. Service members living overseas (I-129F part C question 1). For this reason, I feel that my first application should not have been denied. Had my first application been approved (submitted Mar 07), the process would have most likely been completed before I was due to return to the U.S. in Oct 07

sounds like a good reason for an expedite to me! USCIS messed up and put out bad gouge, so they should make it right.

operative word: SHOULD...they SHOULD make it right. i hope I'm wrong, but I wouldn't hold my breath for them to expedite. then again, I'm everything but optimistic in my views of the USCIS right now

I am not holding my breath for them to expedite. But like I said: If I don't try I will never know...

well, you're in with a chance at least; they do SAY they may expedite in cases of USCIS error... all the best with it; you've certainly waited a long time sad.gif

Yup! They definitely made a big error! My fiancé was stationed here in Germany (he left 3 days ago) and we applied for a K1 visa in May at USCIS in Vermont. That is the way it should have been. I don’t understand them, it’s not like you are the first person applying from overseas, especially from Germany.

I still didn't get news back... So I guess I got denied...
