I have tried searching the forums to my applicable situation but I will just go ahead and ask and I will really appreciate if you people can provide me some guidelines.
1.) My wife, who is the US Citizen and my sponsor, has lost her job. We are about to file for I-751 by the end of the month. If she applied for UI, will that affect the outcome of the decision in any way at all?
2.) Since she is the sponsor (along with my Father-in-law), are they required to pay it back in any way the UI that she might get?

Thanks a lot for all taking time to answer!

Question 2: They are sponsoring you, not the USC. Unemployment benefits are based on how long she had worked for the company and her salary. It is payed by the employer, not the government.

Question 1: It may or may not allow you to fall under the 125% requirement above the poverty level.

Gaby&Talbert,

Point of clarification: Unemployment compensation is paid through and administered by the (state) government, funded by employers and (in some states if not all) their employees.

1) Whether or not your wife applies for UI should not have any impact on your I-751.

2) As the others have said, your wife will not have to pay back UI.

ETA: Hope yuor wife finds a new job soon.

Good Luck!
