I filed my I-130 back in the end of June and received my receipt notice in July. Now that its August, and I want to file the I-129F for my wifes K-3 visa, do I have to pay the $455 fee since I paid for my I-130 while it was under the old fees? Thanks.

I think under the new fees, the I-129F is free... is it not? I think you were looking at the I-129 , that is something different...

I filed my I-130 under the old fee system, $190. Its now $355 or something. I want to file my I-129F under the new fee system, which was $170 and is now $455 or free if its for a K-3. Just want to make sure I'm not gonna get it kicked back because I'm kinda avoiding the $170 fee I would of have had to pay.

Free if they paid the higher fee for the I-130, the OP did not they paid the lower fee before the rate hike.

Note, The K-3 can be an expensive visa undertaking, AOS from K-3 is $1010, you just may want to stick with the CR-1, it takes just a bit longer than K-3, I have been seeing cases where the CR-1 reaches the consulate at the same time or a few weeks later, and the consulate tosses the K-3 in favor of the CR-1.

The CR-1 results in green-card, and work authorization upon entry to the USA the K-3 does not, you then have to file AOS for $1010, and can wait quite a lot of time waiting for Green-Card.

If you still want to stick to K-3, you will have to pay the fee for the I-129F.

Thanks for the info, I'll probably just stick with the I-130. Funds are tight, and the processing times don't seem that different. Thanks again.

acutally i had this same problem when i called the uscis customer service line they said i could luck out and not have to pay for the I-129f or they can make me pay because i paid the old fee for the I-130! so i ended up paying both just to be one save side!!! (just so there are no delays) so you now dont have to pay from what is states but to be save you might want to!!!!
