Hi all,

I am another one of those "beat the fee increase" filers.
I mailed my packet to VSC on 7/28, received 7/31.
As far as I can TELL, I used the correct version of the form and did it all correct.... HOWEVER....

My husband's card expires on 8/24.

WHAT IF.....
1. NOA1 doesn't reach us before then? Are we technically out of status?
2. I did do something wrong (used wrong form, etc.) and the whole packet and check is sent back to us as it seems has happened a lot lately? By the time it gets here, judging from current timeframes, it will be AFTER my husband's card has expired and OUTSIDE of the 90 days we are allowed to file???? Are we completely out of luck or what? Does USCIS at least make a note of when the original is submitted or do we have to apply for special consideration to re-open??????

Here I was thinking that this would be the stress free part of the process.... Now, after reading this forum, I think I'll be having a nail-biter month until I see my check cashed!

as far as i KNOW, from reading the FAQ and stuff, as long as you file w/in the 90 days, and it the USCIS receives your application in the mail within that 90 day window, then you are okay.

DH's card expires around the same time; we send ours on june 16th; received on june 18th, and got the NOA today; it was dated for July 18th.

hope that helps; i think the reason most people want to get it sent in as soon as possible is to avoid any problems should the application be rejected b/c of some problem. that way, you can fix it and get it back in before the deadline.

however, this doesn't ALWAYS happen, so as long as you sent in in on time, and they received it on time, you should be okay.
