So I received an RFE today for my husband's I-485 application... SOB!! Anyway...it says that we didn't submit any W-2s with our I-864 (BS! I have the photocopy of our packet with them in it!!) Oh well...anyway, I am RE-submitting them but it also says on the RFE the following

"Your are ineligible for interim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2 until ninety (90) days after the missing initial evidence is received"

Does this mean that we have to wait ANOTHER 90 days before my husband will be allowed to work???? We submitted our package back in May so we have already waited two months. We have a baby and my little income is not enough to support all three of us. How do they expect immigrants to SURVIVE here if they can't work!?!?

If anyone has any info I'd really appreciate it. Thanx.

they said that on ours too... EAD came about 6 weeks later. Don't sweat it - it's USCIS - they don't really know what they're talking about .

hi there...i havent gotten this far in the process but i do believe i remember someone else having this same issue...and they resent the info and it was okay....

We just finished assembling our packet and are going to mail it in the morning. Guess I better get extra copies of those W-2's.

I think they probably lose stuff and misfile it all the time and then say they never got it. Just send it again and you'll be alright.

They did it to us too, I think they're just buying time. I resent it and it was fine.
