Apply immediately anyways. Even if you don't end up getting it for those first 90 days, you'll still qualify for the maximum allowed weeks after your EAD/Green card shows up. If you wait to submit until your EAD/GC shows up you'll lose out on probably a dozen weeks if not more of your claim.

OK..
I'm an EI virgin and really had no idea about any of this (Flames, you suck) anyway! LOL 
So...My last day of work is Friday....I have my ROE from my last job that I worked at (about 7 months ago) and I talked to my HR dept and my HR manager is going to have my ROE ready for me before I move on the 19th.
I move exactly 1 week after my last official day. I'll be filing probably Monday the 21st once I get to the U.S.
What if I don't get the EAD stamp at the POE?
Can I fax in all the documents needed like my ROE, bank statements (do I need those), pay stubs, etc. or should I be snail mailing it all. Also, do I need to send in a copy of my marriage license?
What are these cards everyone is talking about...mailing in cards, getting cards...wtf, confusion overload.
Weird...this is all so weird...I never had any clue I would even be able to do this...if I get approved, it will be awesome!

What exactly do they need to apply for EI? I anticipate moving on July 24 (if I get approved, cross your fingers) and will be applying as soon as I get there. My last day of work is July 18. I probably won't have my ROE my then but I know I can apply without it and send it later. What else do we need to apply? Do we need paystubs? Bank statements? Thanks

1) You can fill out an application online. Do this immediately after getting to your new home in the US.
2) Snail mail your ROE if you have it. Or mail it it later whenever you get it.
3) You'll probably get a one page questionnaire in the mail a few weeks later. Mail that back along with a copy of your passport showing K visa. Send a copy of your I-94 as well.
4) Every couple of weeks you'll get EI cards in the mail. These are what you fill out and return (saying if you've worked or not)
That's basically it. The EAD stamp may be necessary to work in the US. But all Canada EI wants to see is the I-94. They consider the I-94 to be a valid work permit.

Thanks a bunch! Not sure what you mean, but you can't apply until your lovely self is already in the US, stamped visa and stamped I-94 in hand. I'd say beg the customs agent for an EAD stamp, and if they assure you it's the same thing the way they did to me, get it in writing from them

I'm having some lovely EI drama at the moment, I'm waiting for a call back from them as they're looking for the missing parts of my file; aka the Visa and I-94 copies I SENT WITH my ROE, which they DO have.
Just got the call, it's all missing. Have to fax everything but the ROE in again RIGHT NOW. Can't find my best weeks doc. ARRRRGGGH!!!!

That seems to be one of the inconsistencies for the k1'ers--the EAD!! Depending who is looking over ur file, the EAD is not required. Read on here of many K1'ers receiving EI with no EAD stamp. And many have applied while still in the Canada.

I've been dragging the RM 00203.500 with me everywhere, and offered to send a copy to EI to support me not needing an EAD. They said they didn't need it.
I took it with me to the social security office in case I got flak when applying for my SSN, but all the girl said was "well, haven't you done your homework!" and didn't need to see it. Woot! Wasn't expecting that.
(For anyone wondering, RM 00203.500 is the social security policies document that states that K-1s are covered under "C. Policy: Employment Authorization by Class of Admission", K-1 is in that list. Helpful if anyone is giving you grief about being authorized.)
My guy doesn't get home until 30 min before the EI office closes, and I need his help to get this stuff faxed off. I'm hoping like heck he doesn't dawdle and gets his honey home STAT!
The woman I talked to today isn't the woman handling my case, but if I can get stuff into her this afternoon, she'll file it in my file so it's ready when my case handler is back in the office. I wish the nice lady who went hunting for my missing docs was the my case handler.

They told me I could not file unless I had the EAD card, which I did not have.
Needless to say they denied my appeal and had to pay back money I received after I quit my job in May/05. My ROE said moving to the USA. I drew EI from May 2 until I moved on May 25/05 and they told me I was not entitled to draw it because I quit my job.
They are full of chit.

I resided in NS before coming to the USA, but I didnt got hrough the local EI office, one filed through the interstate branch, which is in Ontario

I filed my EI online application yesterday. They said they need the ROE, which was submitted by my employer electronically today.
Now, I need to submit the rest of my stuff. What do I do with that terrible stamp "Employment Unauthorized" that is on my I-94? Submit it along with the RM 00203.500. Should I fax everything to them or wait until they request the documents?

Re-apply at the Belleville, Ontario office TODAY (the interstate claims office used for out of country EI)
Nova Scotia wants you to be in Nova Scotia. Belleville is specifically for foreign people such as ourselves.

I applied online just now.
It went well I think.
The only thing I was confused about was it asked for specific dates of weeks I made under $225.00...my last employer (Before Lowe's) I made under that pretty much every week so...I just left it blank...
I'll mail in my ROE, copy of my passport and I-194 thingy in it.
I'm still waiting on my ROE from Lowe's so I'll mail that in when I get it.

I hope I get approved, if not...no biggie.

I think they need the actual official ROE mailed in.
The weeks less than $225 are probably weeks that they don't use for calculating your average weekly income. Say you worked 20 weeks at $300 a week and 1 week at $150 a week. The normal average weekly salary would be $292........... [(20 x 300) + (1 x 150)] /21.
But by not using the weeks below 225, your average salary would be [(20 x 300)] /20 = $300 a week.

I will. I applied for my SSN this morning. The lady that assisted me at the office was quite confused over the stamp and said that it should have been stamped "Employment Authorized", if anything. She said that until the SS office receives more information from USCIS on my VISA, I won't get my SSN. She also suggested that I go to the USCIS office here in Chicago and discuss the issue with them.

Larry isn't working on Wednesday so guess where we will be....
I received a letter from EI today when I got home from the SS office. It's more of a questionnaire. They are asking if I have a working visa issued by the Government of the US authorizing me to accept employment here. If yes, they want the visa number and a photocopy of the front and back fo the document. That would be my I-94, wouldn't it?

In regards to your last paragraph, the answer is yes. That would be the I-94. I would put yes, you have a working visa on the questionnaire.

Well...here is where I'm at with all this crap. Yesterday, I got 3 weeks of EI cards in the mail
Today we went to the USCIS walk-in office in Chicago. The supervisor....

....indicated that there must have been something on my file for the BPO to stamp my I-94 Employment Unauthorized. When I mentioned to her that other K-1 Visa folks have not got that stamp, she firmly said they have nothing to do with your file. She also said that in order not to get that stamp, people must have applied for their EAD.
So now, I have to send my I-94 in with the questionnarie I received on Monday. It still has the dreadful stamp on it. I'll send in the documents from SSN to show that we are actually authorized to work. I'm afraid that dumb stamp is going to see the end of my EI cards.

Even in the event that you get denied for EI, the worst that would happen is you don't get it for the 90 days. You could still resume it after getting your EAD/GC down the road. And you'd still come out ahead of me. The reason being you'll have the full amount of hours on your ROE recorded from the date you applied (now) rather than waiting for the actual EAD approval to apply like I did (and lose many weeks of max claim.)
Why don't you phone up the POE you came through and ask what the procedure is for K-1's coming through. Ask about work status. I would ask why they put unauthorized on there. Why not leave it blank or do as other POE's do and put the Employment authorized stamp on there. See if they can fax you some correct information.
I think EI should still approve you for a claim right away since they're just looking for the I-94 itself. They don't care if has the employment authorized stamp on there or not. Of course none of us have heard of an unauthorized stamp before either.

I think I will call the POE and see what the procedure is for K-1 Visa's. I know that Ontarkie crossed at the same one as I did and she never received that stamp.
I will keep mailing in the cards and hopefull we'll be filing our AOS mid August. I just get the feeling that I'm going to be raked over the coals with mine.
Maybe I should set up an Infopass appointment. See if I can get any farther that way with this stupid thing.

I got 2 sets of cards tooo. The first for 2 weeks and the second was for 1 week. Now when I check online they tell me I have another set to complete and submit on August 8. I haven't received them in the mail as yet, but I'm sure they'll arrive soon.

Most times I called and reported over the phone...I found that rarely did I even get the cards in the timeframe I was supposedly supposed to submit, they are quite friendly. Generally, I spoke to the same woman most times

How'd you report over the phone? Actually call into the office?
In the US, I've found that the telephone reporting phone number won't accept my call nor will the internet reporting website. I've always had the cards show up late. Heck, I just mailed the ones for the 2 middle weeks of July earlier this week. Never been an issue as far as losing a week.

Called the Out of canada claim office # from your letter that you received...each time they said 'you can wait for the cards,' but I said they didn't seem to come in a timely fashion....I listed the number a few pages back i think

1. Does my husband have to have the EAD for him to apply for EI? (We don't have it yet, nor did he get the temp stamp at POE.)

ROE - Record of Employment.
He can apply any time. All he needs is a copy of his K-1 and I-94 to submit along with his ROE. His employer may have submitted it electronically.

Your employer HAS TO have the ROE to you in 5 days, that's law (I worked at an employment centre so we had to know these things).
Generally, a ROE must be issued within five (5) calendar days of the interruption of earnings or the date the employer becomes aware of the interruption.
You can apply online for EI as well as fill in your "cards" online:
http://www.servicecanada.gc.ca/When EI gets your application, they will automatically send you cards in the mail (takes sometimes 2 weeks to receive them) and a "PIN" number. You can easily change your PIN by calling the toll free number (if the one they issued does not work). Getting cards does not mean you have been approved to receive EI - I got cards & thought that I was eligible until the website said the usual "we are processing your request, we hope to have a decision by Aug 14, 2008"...blah, blah, blah...I got a call today saying that I wasn't eligible...I was hoping that someone inexperienced would approve my app. Anyways, once to create a profile thru Service Canada, no need to mail anything, do it all online.

I can't seem to log in online. Is anyone else having any problems assessing the online services. I created an account the other week but ever since I can't even pull up the page to sign in! Any help would be appreciate. Also when I called the interstate office I had to leave a message and it took them over a week to call me back! I really hope I am approved for EI, we still have applied for AOS as we are waiting on the doctor to complete my vaccination supplement so from the looks of it I won't be working unitil December if I'm lucky!

Hey all,
I have another question. On my husband's paperwork from the EI people, it has this question:
If you are not a US Citizen, do you have a working visa issued by the Government of the US authorizing you to accept employment from the US? Y or NHe doesn't have the EAD approval yet. So my guess is that we have to put no, but I just wanted to check with all of you wonderful experts.

On the chance that we are somehow supposed to mark Yes, the next question asks:
If you have a working visa for the US, provide your visa number...what would that be?
...and a photocopy of the front and back of the document.what would the document be?

Okay, just spent some time reading back a few pages. It seems we can be considered work authorized, so we will put yes there, but I'm still confused as to what his visa number would be. Would that be the K visa number? Or something on the I-94?
