Full Version: Going overseas while case pending

Hi everybody,
I filed for I-751 to remove the conditions Nov 2006 at TSC. My case is pending and I haven't heard from them yet...! My conditional card has expired Fev 2007. I did receive a letter from USCIS extending my status for another year. I do work and go to school for my bachelor degree.
My concern here is that I am planning on going overseas next December with my wife and all I have as proof is my expired GC and USCIS letter. Will be there any issues with custom service if going overseas and coming back to the states? I mean are the expired GC and letter enough for me or do I need to get an additional USCIS document proving that I am legal in the states?
Also is the one year thing means I am legal since the day I received it or since the expiration of my GC?

Just take the expired card, and the NOA1 for I-751 with you on your trip, the NOA1 proves legal status.

This is a FAQ and is asked at least 1 time a day.

Ok, I do have another question...
I will be eligible to file for N-400 (Naturalization) next november. what if I don't get my 10 yrs GC by then, do I go ahead and file for naturalization or are there any procedures I need to follow while my I-751 is still pending?

Yes, you can file the N-400 before you get the 10 year card, this just forces them to adjudicate on the I-751. Just include a copy of the expired green-card, and NOA1 from the I-751.

When you are eligible to file for naturalization is determined by when you first got LPR status, that is the date on the conditional green card, as long as you have been resident for 18 months and have not been out of country more than 6 months during the 3 years from getting LPR status.

I just came back from a trip overseas and I had no problem getting back in. my case still pending that I submitted on Dec 2006 to TSC, and since Biometric appointement which was on Jan 11 2007 nothing heard.
when was your biometric apointement? and have you tried to call TSC to inquire about your case?.
Please share if you have any info.

hmm, I'm surprised you haven't received your letter of extension yet. We applied in Feb and got our letter the next month.

Hi there,
I had my BIO on Dec 8, 2006 and still waiting.... I called twice to follow up with USCIS and I couldn't talk to anybody.. All I got computer thing saying that I had to wait... So I am waiting...
If you have any more info about this, please share...
