Full Version: Is I-864A applicable to DCF?

Hi all,

Sorry if this has been asked before, but is a I-864A ever possible to use with DCF?

If not, I have asked the MIL to fill out the wrong form, and I think she'll explode if she has to do another!

We have both lived in London for the last 3 years, but my partner has had mail including bank statements sent to his mum's house throughout. That will be the domicile that he will be re-establishing. As we'll be moving together, neither of us will have income, so his mums going to co/joint sponsor,

but which is it? blink.gif

Can she be a household member, even though she'll only be a household member once we get there? Or do i have to get her to try to bend her mind around filling out ANOTHER one of these weird forms. ohmy.gif

If your MIL is your only co-sponsor, she has to file an I-864. If she is using the income of other members of her household, that's when the I-864A comes into play. Remember though that your partner's UK income does not count for the purposes of DCF, so it looks as MIL is the co-sponsor.

If only her income is being used from her household, then she must use the I-864, not the I-864A. Why not fill the new form out for her, emial it to her and she can just sign it and send it back.

unsure.gif So just in case I'm being a dummy, have I got this right;

main sponsor and additional sponsor physically live together = Joint Sponsors (I-864 + I-864A)
main sponsor lives elsewhere to additional sponsor = Co-sponsor (I-864 + I-864)

and the fact that the main sponsors mailing address and US domicile is the same as the additional sponsor doesn't count, cos he physically lives elsewhere? wacko.gif

That's basically right... hope your MIL isn't too annoyed! smile.gif

One small point, there's no difference between "co-sponsor" and "joint sponsor". If your husband lived with his mom, he would list her income on his I-1864 and, as a "household member", she would fill out a I-864A. Since he doesn't live with his mom yet, she's the joint sponsor/co-sponsor and needs to fill out a I-864.

kicking.gif Thanks again for your help guys, that's cleared it up. Thankfully we don't need the form for a long time yet, so i think i work out a way to make it easy on the MIL in the mean time.

Just a note, I'm sure I can't be the first one to get this mixed up, is there anyway it could be added to the AOS guide?

Ok just want to see if we got it right since I am now a little confused LOL

My co-sponsor filled out the Form I-864, Afidavit of Support under Section 213A of the Act
she is not a relative and is the only Co-sponsor.

Please tell me that was the right Form for her to fill out?????

If the USC does not live with the immigrant's co-sponsor, then yes, the co-sponsor needs to fill out the I-864. The USC also has to fill out the I-864 as a the main sponsor no matter how much or how little they make/have.
