Hi...

They say if you are married to a USC for at least three years ...you can apply...

I'm married since 2003, however I've just saw that my GC says ..resident since 3/4/2005

do they go by the date on the GC or by the years you have been married?

If they go by the date on my GC that means I will be eligible only in 3/4/2008

I got confused...

Your three years start once you become a (conditional) permanent resident. If you remain married to your USC spouse that is. Otherwise it would be 5 years from being accorded resident status. You may file the N-400 up to 90 days prior to reaching the 3 (or 5) year mark.

DH's conditional permanent resident card is dated 10/28/04. All this time, I've been thinking that we could send in his N-400 on 07/28/07 - in my mind, I kept equating the 90-day thing with "3 months" - but that was wrong!!! When we counted 90-days back from 10/28, we landed on 09/01 ..... which for us is a total bummer because the filing fees are going up in a few days. crying.gif

How do you get 9/01 as being 90 days before 10/28? Try counting back again. It should be around AUGUST 1
