DAMN IT. Today, I found out that my dad was denied his AOS interview in the USA wrongly, he should have been approved. I've confirmed this with another person. My dad was required to leave the U.S. because he was subject to 241(a)(5) according to his denial letter for AOS interview in 2000 and 2004... 241(a)(5) basically says that any alien who entered after deportation again is subject to re-instatement of orders and does not have the right to DUE PROCESS. So, he was stripped of his due process (as in court) wrongly, denied of his green card wrongly, AND has had to be seperated from us for a while. Two court cases in 1999 and 2001 stated that 241(a)(5) COULD NOT APPLY to those who benefit under 245(i), AKA my dad. DAMN!!! I'm going rampant mad right now.

Just for anyone interested my husband landed at Atlanta Georgia this afternoon and I have not talked to him yet. Immigrations personally called me and interviewed me with questions about our meeting, when we met, how long was I in Pakistan, when did we marry and exact date that I personally filed for his petition? This is heads up to anyone that may get a call. I am heading to the airport in one and half hours and hope he is there. Wish us good luck. And when I got my call the caller ID was blocked to show private number and the gentleman was very rude. He never answered my question when I asked if all is okay? Wish me good luck!

I am sorry about your dad. but, when he got deported why did he not just file a waiver?
instead of EWI? thats what jacked him up. now he is facing 10 year ban-life long.
at this point you could see an attorney see if he can file a waiver.

I don't think you understand. My dad's suppose to have been approved IN THE US during AOS in 2004. He wasn't because he was placed under 241(a)(5), which CAN NOT apply to him. And currently, he has no bar, but he has still had to wait 11 months outside of the U.S. when he wasn't suppose to. Why didn't he file a waiver? because he wanted to come in. It didn't mess him up? why? because the laws of 1990 applied to him and they still do instead of the 1996 law which requires a waiver. Understand what i'm saying? It's a VERY complicated case. There were 2 cases that were held in the courts and those guys were deported/re-entered and they ALSO left/re-entered MANY times before AOS. My dad only deported/re-entered, didn't leave/re-enter again like those guys who were STILL granted green card in USA. My dad's case has been mishandled. mad.gif An attorney has already confirmed.

Thanks for the prayers. We got home last night his POE was bad experience. He had long extensive interview with two persons and last long time. I think it was total over 2 hours and they lost his luggage. Delta lost my 2 cases to Paksitan and were never found. Now Delta has misplaced his from Atlanta. We hope to have them delivered or found today. Have a good day everyone and wishing everyone together with their loved ones soon.

Senate has passed the immigration bill, all hail the Senate, now to the House. Just letting you guys know that it affects. If the bill passes, anybody who has a waiver under unlawful prescense or 212(a)(9)©, consider yourself to be COMING HOME with a $2,000 fine if it passes. Nothing for misrepresentation sadly :-(!!!!

So I am confused BIG TIME. DOS has no clue why visa was not issued at the embassy. They don’t know about AP/AR on our case. What should I do now? I called DOS and they were not aware of the AP on our case, all they knew were the date of April 11th as interview.

So who administers AR/AP???? DOS can’t answer anything for me. What should I do? sad.gif

1.. call DOS back - ask them to check the other SCREEN...they wont do it unless you make them look.
2.. AR/AP takes 19days - 2 years

Just an update for everyone, i went to pakistan for my wife k3 interview and she passed. kicking.gif they issued the visa a week later and i went to pick up the passport. and now we are here in the states.

i want to thank everyone that helped out and prayed. now the AOS begins.

i will continue to pray for the ones still waiting, may ALLAH (swt) make your journey smooth and problem free.

your bringing a MALE to the USA. ALL MALEs are placed on AR/AP
thats why the visa was not issued and he was placed on 221g. temp denial.
dont let the word denial alarm you. its that the embassy had to give you someting
either a VISA or an EXCUSE. so the exusse is 221g temp denial < pending the security checks >
once the security checks are clear - he will have visa in hand. if he left his passport and was given a token they will send the passport with visa via AMEX courier. so in the mean time you just have to wait.

The women who talked to me was very rude and had no clue what she was talking about. She even disconnected the line without answering me what is going on. Damn these kind of people. I was on hold for more than 15 minutes and finally that was how I got a response from DOS.

Then again I called later and this time I talked to somebody else and she was better and she found that he is under AP and asked me to call them again next week and they may have some updates by then. She wished me Good Luck too. So I think good and bad ppl are everywhere and those bad apples bring the image of the whole thing down. May these ppl experience some hardship in life too so that they realize it for themselves.

they are rude sometimes - I bet you got ROSE. she is the worst.
most of the time they are pretty nice. but, rember when you call DOS always remind them to check the other screens. they wont!!! be patient.. it takes forever.
now what I can tell you is expect him to get a field investigation. we got 2.
til that happens migh as well kick back and wait.. so far I have been on AP for 9 months..
the longest on ISL is 10 months..

Lari , sorry you're going through this as well... don't have too much input for you unfortunately other than just try your best to be patient - it's easier some days than others... i never get much info out of the DOS people other than it's "pending"... I keep telling myself one day insha'Allah... hang in there...

oh lari i feel so bad for you..if your spouse is from India than there was one couple nick is VICKIBALA something like this and Her fiance is from indian and they had interview in chennai embassy but after interview he was in AR..but DOS say embassy never request any security check on HIm and Embassy say we sent cable to DOS....,and DOS keep saying what is going on is under embassy we not doing anything...and they are dealing with this situation from 5 months...i hope things will work out for u

I don't get this... if someone had a previous AOS interview and went through the same security check, would he/she still be subject to the security check AGAIN? One of the immigration officers told us no and he knows we are in Islamabad.

YES you can have security checks while in the USA - when waiting for AOS.
ISL embassy would not really know. they are not the ones makeing the decision for AOS.

actually it depends on how long ago the security check was done. Yes. it shows up in the system that the security clearance was done BUT every security check has a certain validity date.

a friend of mine from Pakistan, he was put in security check at the NVC level and they wanted him finger printed, which took 3 months. So when the case arrived in Pakistan, he was cleared and no AR/AP for him!

I have been talking to people in DOS and I made a list of the VISA SPECIALIST. a couple of days ago, I talked to one specilist who was a witch and very rude and even hung up on me. She sounded like if she was African American, I am not sure though... Well here is a little guide to who is nice and who isnt at the Visa hotline.

how was that racist? I am pakistani, I have a Pakistani accent! I am not stereo typing but you can tell by someone's accent if they belong to an African American accent. What is so racist about that?

Or is it, you have to make a deal out of everything?

ok people since its end of the month! So apparently the embassy will be having a visa review meeting. I guess probably on Tue-Wed ( or even Thu as Mon was a holiday).

So how do these meetings work? Anyone have any idea? Do they decide on the same day if visa will be issued or not? when is a good time to call DOS to see if any updates?

It's not racist.
Awesome, the immigration officer told us he wouldn't need to be put on AP/AR, but we aren't sure. He had his finger prints done about 10 times before he left since he was granted temporary stay. They took his fingerprints EVERY month until the day he left since he was granted temporary stay. Also, he's had full fingerprints done in late 2004.

Most of the time when you speak on the phone with someone, you can very well say if the other person is African American or Chinese American or Indian American or Philipino American or Arab American or any other for that matter simply by their accent and pitch of voice and this is only a descriptive comment , not a racist one. Please don't mind. When I speak, people think I am middle eastern and they ask me if I am and I never find this racist.

Anyways! Next week is visa review meeting! Who else is excited! I think 5th or 6th is a good time to call DOS to see if anyone got approved. I predict we will hear some good news!
