I am delighted to inform my friends that i came to America on OCTOBER, 09,2007 by emirates airline, the journey was nice but so tiring. Now we had to file for a adjustment of status so any brother like to tell me what is the procedure to file for AOS and what documents require for filing of Adjustment of Status on K-1

If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.

Well, I am happy to annouce my wife has finally made it here. She received her K-3 visa (passport and paperwork packet) on Sept 28. That is 13 working days (or 17 days) from the interview date, where they told us 7-10 days. By the grace of Allah, her POE experience was very smooth, infact we were done in 10 minutes. The border agent did not ask any questions from her, just from me as I had filled out the customs card and put my information on it. All in all a very smooth and pleasant experience. Wishing all folks, all the best and a speedy reunion with their loved ones. Thanks for all your support.

Congratulations!

thanks Mary, and all
As u know my CR1 interview in London on 9th of November 2007 , but when I checked the Islamabad forum there is a list who are stuck with AP (administrative process) after their visa approval , is that mean every one (Pakistani) have to go through the Administrative Process with all US embassies ? Or is that only in Pakistan?
faal4anisa
Hi Khurrum,

Thanks brothers for such a explicit information on Adjustment of Status and i be obliged if u tell me what the fees for Employment Authorised Document (EAD). Moreover i pray for your wife that she get visa soon and be with u, brother my name check was completed end of july and then finally i got a call end of september to collect my passport, visa and seal envelope.

My port of entry was at JFK it was nice and smooth but i had to wait a long for my turn otherwise it was nice now getting ready to get married my sweet fiancee and start our adjustment of status. Finally keep your finger cross and hopefully your wife get her visa soon and i can understand this waiting period as me too had to passed but once your journey is completer then all that waiting period becomes a sweet reminiscence

All Pakistanis seem to have some type of AR/AP and know of one in AP in Canada now but not sure how it will effect your case in the UK. Since 9/11 males have been enduring longer waits out of Islamabad than from other embassies. I always try to stay positive but not rosy and when I post a male will have AP as I try to make all persons realize that this can happen and not to make plans that can be an issue like purchasing plane tickets before they have the visa in hand. Good luck and praying all the best for your interview and no AP out of the UK or a shorter AP.

Thank you ver much and as far as the fees goes for EAD and the Travel document, they both are included in this new fees for AOS.
According to USCIS " If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, then no fee is required to file a request for employment authorization on Form I-765. You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of an I-485."

Best of luck and feel free to ask any AOS questions as I have doing this research so I can file for my wife ASAP (Inshallah) after she gets here.

:: For K1 Visa Holders ::

As a K-1 Visa Holder you are eligible to receive a SSN upon producing a valid I-94 (unexpired). Do
not wait until you only have a few weeks left until your I-94 expires to file for a SSN. Many SSA
offices will not allow you to file for a SSN if your I-94 is about to expire (generally 14 days prior
to the expiration on your I-94). On the other hand, you should also not file for a SSN too soon either.
You should wait 2 weeks after you arrived in the US before applying for a SSN. If you go too soon your
record of arrival will not be in the SAVE-ASVI system yet, and it will require manual verification from the
USCIS. As this will add weeks to the period it takes to process the SSN, it is advisable to attempt to wait the two weeks to be safe. If you have waited the 2 weeks and they tell you they can not verify you arrival record via the SAVE database, you may allow them to to process it (but remember the potential delay for manual verifications). You can ask if they will check the computer again for you in a few days or return personally to have them look again -- thus eliminating the manual verification. The manual verification will require the SSA office to file a G-845 with the USCIS.

To apply for a SSN you will need to go to your local SSA office and bring the documents below. These
documents are proof of your eligibility to file for a SSN:

1.
The SS-5 form you downloaded and filled out (they have some at the office if you forget).
2.
your Passport (with the K-1 Visa in it)
3.
your valid I-94
4.
another form of valid ID (as defined in the SS-5 instructions)
5.
You should also bring the document RM 00203.500 that you printed out
Make sure to bring all the documents above because some offices have staff that are not aware
that a K-1 Visa Holder is eligible to file for a SSN. A friendly reminder is a nice thing to have -- if not
you could be turned away incorrectly.

Once you have successfully applied for your SSN, the SSN card will come in the mail in about 2 weeks. You can check on the status of the SSN application and/or often get the SSN in advance by returning in person (try calling) to the SSA office. If you need your SSN before it arrives in the mail you may ask them for an SSA-7028, Notice to Third Party of Social Security Number Assignments, to be sent to your employer or other interested third party once a SSN has been assigned. Your card, when you receive it, will be marked with the words "VALID FOR WORK ONLY WITH INS AUTHORIZATION" indicating to an employer that you must also have an unexpired EAD to be eligible to work.

Hello

I am living in U.S.A and am a US citizen. I have applied for my fiance and he is planned to come soon since he has already got the k-1visa. The problem is that I do not wish to marry him any more because we broke up. I want to cancel this process. How do I cancel this process?

Thank you.

Hello everyone, wanted to post a non-immigration related question ... Anoybody on the forum have information on VoIP services in Pakistan, specifically Islamabad? I want to know if there are any companies offering residential VoIP service in Pakistan? If there are, how reliable are they and how is the quality? I'm currently using Packet 8 to give mother in law a US ph # so that she can stay in touch with my wife. however if I were to get a Pakistani ph #, then that allows us to stay in touch with a lot more people. Any information would be much appreciated ...

I use Get call (http://click2dial.net/getcall.php) which gives me a local number for Pakistan then I forwards it Grand central (http://grandcentral.com) which offers a free hunt group so when someone calls me from Pakistan it is local to them and my home, work and cell phone all ring at the same time and I can pick up the call where I can.

Eid Mubarak as well as Belated Eid Mubarak to other,

Guys would like to know the some trends in regards to Scheduling of Interview was IR1/CR1 Cases at Islamabad. With the grace of God the process has been Smooth so far and hope it will be over in the same fashion and sooner. My Wife Received the Instruction packet 3 from Consulate last week and we are going to submit the papers they requested soon. My only concern is scheduled Date of interview given by Consulate in Islamabad. I have heard that consulate is scheduling Interview as far as Jan or Feb for Interviews for some people (heard this for Attorny). Have you guys experienced this or heard anything like that. according to couple of timelines it seem like interviews are scheduled like month to month and half apart.

Any Updates or experiences will be appreciate. Thanks Alot. (May Allah Help you All, Inshallah.)

Congratulations on getting your packet and sending it back soon. The disappointing news is that they are taking a long time to schdule interviews like your attorney told you. I know since I have been on VJ over two years that it is taking 4-6 months for interviews of any kind from Islamabad and in our case it was 6 months. This consulate is very busy and understaffed and all you can do is ask them to move the interview up if they have any openings. Good luck.

Hi,
I'm a US citizen. I got married in April 2007 in Pakistan. After consulting with friends, I filled i130 when I received the receipt notice then I sent i129f along with receipt notice on i130. Yesterday I received email from USCIS updating me that approval letter for i129f and i130 are sent.
Now I need you guys to advise me whether I should drop i129f and proceed with i130 or drop i130 and proceed with i129f?

Couple of my friends who only filled i130 are waiting for the interview date. One guy got interview date after 6 months and the other got date after 7 months Ghee that's long time.

If I go the i130 route then obviously it's going to take may be 10 months before my wife gets visa however if I understood correctly i129f is much quicker then that but don't know the timeline between the approval and visa?

Also if someone can please explain what's the process like once my wife enters US on i129f.

Thanks,

Rainbow007

Salaam Rainbow,

Here is a link to pakistani community forum. You will get better and fast response. According to recent approval in Islamabad, for K3 (3-4 month) and CR/IR(6 month). I dont think you will have a choice which one to pick. Your K3 will go much earlier than I130. I130 stays in NVC for more than 2 month where I129 only stays for couple of weeks. Good luck to your journey good.gif

W/Salaam,
Thanks for the info Asmo. I have heard that if I go for i129F then there's a lot of paper work that need to be done once my wife arrives in US and hearing from people that it's better that my wife waits in Pakistan and comes through i130 and she will get her Green card immediately.
It's difficult to wait for 10-12 months if I go for i130 however at the same time if I go for i129f I hope it won't create too much headache for me as I'm working professional and can't take days off to collect proper papers etc...

Please advise!

Your I130 and I129 approved together. I don't think you have a choice which one to pick. I130 will stay and on hold @ NVC for AOS and I129 continue and proceed to the Islamabad consulate way before than I130. Again you don't have a choice. In a positive note: K3 is much faster route than CR1/IR. Good luck good.gif

Please take this advise seriously since I was stuck in the FBI Name check for more than three years and unfortunately, I-485 is one the petition that requires Full (definitive) FBI name check. So, it's not just that waiting game. If you file I-485, your wife can get stuck in this limbo forever, so please go for CR1. IR1/CR1 route is little bit longer (only couple of months), but it's less stressful in a long run.

Even if you go through the K-3 route, I hope it never happens to you, but you never know. Please see this file and notice that I-130 is not listed here. Thousands of people are stuck in the I-485 process because of this mess created by USCIS and FBI. I was stuck for more than three years for my N-400 and then had to sue both USCIS and FBI in order to get my citizenship.

Best of luck to you!! Regards, kim

You will mail your I-485 to Taxes service center. Please download this file from USCIS Website.
