I looked on the website for the attorney, she is pretty expensive. I will look into it more though. I would like someone local in NY or even NJ. Anyone know of someone please let me know.




My advise is this. if you dont already- consider getting Pre Paid Legal. I have been a member for
5 years something. This should cut down legal cost alot. plus you get free UNLIMITED
consultations. plus the attorney is local.. good.gif

the fee per month is something like 26.00.
you can get cheaper plans < 17.00 > later once your over this hurdle..

Well the price for writing a 601 is pretty much standard and this is how much attornies charge! Yes, having a local attorney would be nice, but Laurel has LOTS of experience with waivers and has a very high success rate.

Eventually you would make your own decission on lawyers, but think twice before taking any step. Talk to Laurel, she has an awesome free chat session on Wednesdays. Where people can ask questions!

www.immigrate2us.net check it out, this is a great resource for waivers. Also have u filed ur paper work? when is the interview at the embassy, if that is the case.. Wait for the interview and then file for a waiver, I think after the visa is refused you have 6 months or a year to file the waiver..

Atif I am praying for all of you to be reuntied. It is such a long stuggle coming from Islamabad and hoping and praying that once Ramadan is completed that they move alot of these cases to approved and issued. Hang in there and you and the rest of the couples are in my prayers.

Waivers cannot be expedited, until and unless its a dire emergency. Is your husband in Pakistan or US? If he is in the US, your safe file all paperwork immediately if he isnt in deportation proceedings.

If he was removed, then he has to file I-601 waiver. If you have filed for K-3 and CR-1 whatever reaches embassy first he would be interviewed for that. Then he would be refused a visa for over staying in the US and would be told that he can file for a waiver, then comes the fun part a waiver needs to be prepared along with fees and submitted. Your husband will be then finger printed and then the wait starts....

Like I said, I know people who have been waiting two years AFTER there interview on waivers. Its just sad, but waivers just take forever (especially for people from Pakistan).

Well I don't know if I should wait for after his interview to get the waiver or find someone to start making it now. I mean on one side what if he doesn't need it and I canmake it later like someone suggested or I make it now and so he can have it at his inerview. I don't know what to do I am so confused. I tried to get onto the www.immigrate2us.net site a few times and it won't go through. Don't know if something is wrong with the server or not. But if you have some numbers of attorneys in NY or Jersey I would apprecate it. I will also talk to Laurel. I know that she is saying that she can get the case done faster, but is it true. I mean really is it up to her, ist't there a whole bunch of gov. BS to go through anyway??

I am a little confused about something. When I file for the waiver for my husband if he needs it ( allah na karay) than do I apply for it here or he does it there. The posts that i have been reading have lead me to believe that he will hand it in over there. Yesterday I called some lawyer that my friend gave me the # for and he said that u need to do it from here. Does anyone know the way? And is it faster if I do it from here? I mean I did all the paperwork thru here so I am not sure.

Drop me a PM perhaps we can talk on yahoo and MSN, I will help you through this procedure if you can provide me with details. I am no lawyer but I have done lots and lots of reading on the waiver cases.

Also just my opinion, but I dont believe in this pre-paid legal stuff. If you are gonna hire a good immigration attorney, it will cost you money. Laurel Charges money but delivers, unfortunately she cannot expedite cases. Islamabad is very slow in handling Waiver cases BUT she has a very high success rate!

A tax attorney cannot give you immigration advice let alone advice on waivers, thats what I think happens with Prepaid legal. I would suggest contacting AILA, they give recommendations on Immigration lawyers in your vicinity too. But lots of scam artists out there so be very careful. I have been stung by bad legal advice myself too.

If he is in the US and has been told he needs to file a waiver then your husband will file in the US. If he is in Pakistan, he will need to file from Pakistan. And the fact that what kind of visa he was in the US for, will determine if he will have to file a waiver.

The good thing is it looks like he complied with a voluntary departure, so he doesnt have to file a second waiver. Ask your husband what kind of visa was he on? IF he was on B1-B2 and over stayed yes he would have to file waiver if he stayed more than 6 months. If he was on F-1 student visa, and stayed in country for years he does not have an over stay as students are admitted on D/S status and over stay does not incur until and unless Judge deems one deportable and then you dont comply with VD.

Prepaid legal has immigrations attorneys! Pre paid legal you request the kind of attorney you
are wanting. for this process I have had the same attorney. for my divorce
I had a diffrent one. Pre paid legal is just that PRE PAID. I have been a member for a very long time
they helped me with my international divorce. The law Firm is up the street in a building. I first got
membership through my own company.

Wow. I am assuming that they are not marriage or family based visas. It is end of the year physical for governmental offices. I am sure they have to wait for more before they can issue student, work, etc. Family based have no limits.

Sorry to say Mary, but they were K-1 visas. My God the officers were GRILLING applicats! They refused three K-1s infront of me! All cases different but the CO said that the dressing in the pictures the bride and groom have too much of good clothes on and they are probably married and not engaged!

All three were refused visas and said that there will be an investigation, I felt like throwing up there.

Ok here is my question to everyone. If lets say one's K-3 approved and the I-130 is still pending. Can the person come to USA and without the approval for I-130 file for AOS or one has to wait for I-130 to get approved.

And lets say If a person has a K-3 visa in hand and comes back to the States and if the I-130 gets approved, can the person go for Consular processing and AOS in the US (both at same times). Just to see where ever he can get an interview first?!

If a person comes back for Consular processing for cr1-ir1 to the country and goes for Consular processing, if put on Admin processing can the person return to the US on his K-3 or do they cancel it?!

I would be much obliged for a response from anyone who has any knowledge regarding this.

My understanding is if the K3 is finished it should of been issued unless the embassy cancels it and proceeds with the CR1/IR1. The embassy has the option of cancelling the one visa if both are at the embassy at the same time. The only way you could come to the USA is if you have the K3 in the passport and then AOS stateside on the K3. So this goes back to the embassy and the status of the K3.

I would think which ever one was approved first is what you could go for but again that depends if the K3 is valid and you have traveled to the USA on it.

It the IR is approved you would have to surrender the K3 since the AP would be for security checks and they would have to be all cleared before they could issue the CR/IR visa.

1.. the person needs an APPROVED I-130 in order to AOS. its reflected in the guides. thats coz,
your are AOS based on K-3 petiton. where as k-1 would have I-129f petition.

2. I would think NOT. because, you have to state rather you want to AOS in the USA or Abroad.

3. I think it would not be cancelled til you have decided on if you will AOS state side or abroad.
you must bear in mind those on AP during this time. will experiance it during AOS in the USA.
so its a chance you wanna take - then go for it. I would think its easier to AOS in the USA.
its only a 10 min appointment.

anyways these are my guesses..
