I have a questions about filing I-864 (AOS). I have copies of all my tax return from last 3 years, but last year income was not of what it was for the pass two year. Worked 9 mos and I was out of work on medical leave for 3 months. I wanted to know if that will effect showing my continues income. I have been with company for 6 1/2 yrs. Last year I just gross less than the previous two years. If this will effort my proof of income, what is that I should sent along with the I-864, copies of Income tax returns, to my wife to take to the consulate? Iam alittle confused and worried the things want go well with this of the short break at end of 2006. Thanks

You can also send a letter from your supervisor (and his or hers too) using the company letterhead.. that way it will be official as to your job (just that you were on sick leave for 3 months).. Also, for two people, as long as you make $19,000+ (I think from the poverty chart).. then you should be fine.. =)

On my income tax I have file my son as a dependant but he lives with his mother. Will that affect the poverty the guidelines. Only one that will be will in the house is just me and my wife not my son. I have right to claim him from the divorce.

You can just estimate for 3 people then should be around $22k - $24k?? not sure... you can check the poverty guidelines

If you have any type of custody and pay any type of support, yes, you need to list him as a dependant even though he doesn't live with you. The household number should really just reflect how many people you are financially responsible for.

Are you asking for the purposes of an immigrant visa or for the purposes of adjustment of status?

I-864 is not used for a K3 visa application.
