Full Version: Who can apply in CDJ Pilot Program

I am very worried that I hired a stupid lawyer who doesn't know what he's doing even though his website says he has more than 20 years of waiver application experience.

My fiance is Guatemalan, and was here illegally for 12 years. He is now back in Guatemala, and we are currently waiting for the fiance visa interview date. Our attorney told us SEVERAL times that when that visa gets denied, we will be able to apply for the waiver in CIUDAD JUAREZ. When the new Pilot Program began, we were even more excited to know that it wouldn't take so long to get a decision.

However, everywhere I read states that our waiver packet needs to be submitted to Guatemala, and CDJ is only for Mexican nationals. I talked to my attorney about this conflicting information, and he ASSURED me that we will get to apply in CDJ and use the Pilot Program.

I don't trust my attorney very much. He tried to tell me at the beginning that I couldn't apply for a pardon because we weren't married, and then I faxed him over Laurel Scott's WONDERFUL I-601 memo which confirms that fiances can apply. He only tried to play off his ignorance after that.

Please help me set this confusion straight! I am so frustrated with not knowing how long this separation will last. And I HATE MY LAWYER!!! I'm going to sue him after this! ranting33va.gif

Guatemala adjudicates their own waivers -- they don't send them to CDJ. The Mexico City district office has jurisdiction over Guatamala, but that's about it.
