Does anyone out their know how often I 601 Waivers are approved for spouses when they were denided a waiver becasue of undocumented status in the United States? My wife is from Guatemala and whe is waiting for answer on our I 601 in Guatemala currently. She was never deported and has a clean criminal history.

Depends on how strong the hardship letter and evidence presented are. Illegal presence with nothing more i.e. criminal record or deportation is certainly easier than more complicated issues. But it's all a matter of the USC proving, beyond a doubt, extreme hardship if the spouse's visa is ultimately denied and the USC would have to relocate permanently to the spouse's country.

Thanks for the information. I provided a bunch of evidence of our stong relationship and how I would suffer without her presence. When we filed the I 601, the package was 1 and 1/2 inches thick full of letters from me, family, friends, and my employer. We had over 50 photos submitted and also included a piece about the Human Rights violations against women in Guatemala

Remember that separation and relationship issues are not extreme hardship. You must focus on medical, safety, etc.
