Full Version: Putting an Approved I-130 on hold

This question is for my cousin who is an American Citizen who is married and has two kids, She along with her husband and kids lives in Pakistan.

She is trying to convince her husband to move to US but while she is in this process, she was thinking that if she applies for the I-130 for her husband,
and after it is approved, is there a step where she can put the case on hold and move further when he is ready to migrate?

She can simply delay responding to the next steps after approval. I'm not sure how long she can delay before the petition is considered abandoned though. A few months shouldn't be a problem.

That is correct. THe I-130 can be on hold up to a year from the date NVC sent you letter stating they have recv'd your petition from USCIS.

Khurram Bhai, your sister has to live in US in order to send her petition to her USCIS service center. If she is living in Pakistan for a while, then DCF can be done which she can check it with US Embassy. But I guess, she is trying to convince her husband to immigrate to USA. If she is in USA, she can send the petition to the USCIS and after the approval she can delay the NVC process as late as for 1 year, in the meantime, she has to convince him. On the ohterhand, DCF process will be much quicker.

DCF is faster and probably more difficult to delay because it never goes to NVC. However, the USC only needs a US address, not actual residency to file with a service center. A "permanent address" with family or even a rented personal mailbox at the UPS store will do.
