Clarky and Tarah
My fiance will (someday) be having an interview at the London Embassy and am just wanting to get an idea of everything needed for the I-134.

I found this on their website:

To substantiate the information regarding income and resources the sponsor should attached two or more of the following items to the affidavit.

1. notarized copies of his or her latest federal income tax return;
2. a statement from his or her employer showing salary and the length and permanency of employment;
3. a statement from an officer of a bank regarding his or her account, the date the account was opened and the present balance;
4. any other evidence adequate to establish financial ability to carry out his or her undertaking toward the applicant for what might be an indefinite period of time.

We are going to have a co-sponsor (or sponsor other than me) and I just want to give them an idea of what we will need. They make over the poverty guidelines, so I know the bank statement and other assets aren't really needed. What about the federal income tax returns? How the heck do you get notarized copies of those? I was planning on transcripts, can you get those notarized? How do you go about that? Just go to the notary and swear that they are yours?

Thanks so much for your replies.

If their income is sufficient, just leave the asset portion blank. The transcripts are fine. No need for the actual returns or any notarizing except the I-134 itself.

Yep, that is what we did.

Bank statements are only needed is you are using a savings account as an asset, if your income is above 125% poverty line the don't bother listing assets, they are more concerned with income.

If your income exceeds 125% of the poverty line, then don't bother with assets, it only gives the consular officer more questions to ask.

In our case this what the I-134 included.
  • I-134 signed and notarized.
  • Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS
  • Photo copy of IRS form 1040, and W2s for past 3 years
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past 6 months pay stubs up to a few weeks before the interview.
If you list the asset things the consular officer then just has more to ask questions about and you will have to provide more financial evidence. I have bank accounts, 401k and other things but did not list them on the I-134.

You should pop into the UK forum and the forum on general foreign embassy discussion. The I-134 is discussed extensively there.

As for the notarizing part - read the I-134 again, instructions and the form itself. You'll see that what you are swearing when and what is being notarized.

Also helpful, go to the galleries section (or under my profile, my photos) and check out packet 3 from the embassy. There is a long set of instructions there on how to go about showing the applicant will not become a public charge. You can use the I-134, self-sponsor, or create your own affidavit according to their instructions. Most people use the I-134 because it is already a set form. Check out the example I-134 here on VJ - it's one of the more helpful example forms because te I-134 has some questions that seem odd to K1 applicants (the form itself is used for MANY visas and procedures, not just Ks, so some questions don't fit right and should/can be marked "N/A").

Good luck!

Thank you all for the help. I wasn't even worried about it until I started reading other people's questions about the I-134, then I started making up my own tongue.gif.

Thanks again everyone

I didn't want to start a new thread for this, but does anyone have any idea how long it takes to receive tax transcripts once you've sent in the form?

Thanks again

How exactly does one determine what 125% of the poverty line is?

Is there a national guideline for what the poverty line is?

How would one find this out?

My father is going to be a co-sponsor, along with myself, and I imagine his $50,000 a year is more than 125% away from the poverty line.

So, if he signs the form, and shows "Hey I made $50 grand this past year", would that be all the info necessary? Would that be enough? Or would we need to do anything else?

You can find the guidelines here:

http://www.uscis.gov/files/form/I-864P.pdf

Read some of the above posts to see what to have your father send along with the I-134. You need supporting documents, like employer letters, pay stubs, etc.

Also, he has to meet the guideline level of his household. So if he has like a wife and 2 kids as dependents, it would be a household of 5 counting your fiance. Make sure you keep that in mind when checking household size.

Well it's going to be myself, him, her, and potentially my brother. Up to a household of four...A minimum of $25k. He makes double that, so...if we just submit that form and the tax records or whatever that show he makes $50k+, would that be enough evidence for them? Based on this thread I'd say yes.

Bear in mind I'd be submitting one too for her, but I make not alot since I'm still a college student!

You can request them by fax and receive them the same day, or request them online and receive them in about a week. Just google "tax transcripts".

Which kind of the transcripts do we need? The return transcripts are enough? This will be fast.
Or we still need the Form W-2, 1099 and 1098 series transcripts? It will take up to 45 days to get them.
