Full Version: Visiting While Applying For Green Card

Hmm...Has anyone tried traveling to the US (for <1week) while applying for the green card? I know it's not technically allowed, but if one is only visiting temporarily and clearly prove ties to his/her home country, is that OK?

My husband, David, visited me a couple of weeks ago for a week. I was a little nervous but he was pretty sure evrthing would be okay. He had visited the US a couple of times before. In fact he visited me for 3 months last summer Aug 06-Nov 06. At that time we had not started the IR1/CR1 process. He had absolutely no issue coming or leaving the US.

Jerryfan5,

Nothing technical about it - a visit to the USA is allowed while the immigration process is underway. As for any visit, the visitor must show that their visit will be of limited duration and after their purpose is accomplished they will leave.
