Since I did not get an answer on my thread, "Waiting" am posting a new topic.
FYI, that Nebraska divorce law posted (1994) is outdated. I called a lawyer. The divorce here becomes final 1 month after decree but no remarriage anywhere in world until 6 months from decree. With this in mind, can I go ahead and send in the initial app now? The INS person was not even sure, but thought since it lays on a desk for awhile it would be okay. (6 months is up next month).
New Question: Where is the up-to-date list of things my guy needs to send to me to include? Does he need to fill out 4 bio papers (identical)? I have tons of chats to prove relationship. What is maximum you recommend sending. I also want to write a letter with important info to include (such as when ex left, and other relationship proof such as number of chats I have as evidence that is not submitted, number of phone calls, etc.). Is this accepted? (not a form letter).
Am in a hurry so he can get it to me right away so I can file before end of month when rates go up.
What is fastest way to send from morocco and will he know where to get pic taken? How much does that cost?

You might want to post your question regarding the divorce in the K1 forum.
You don't need to send proof of relationship now (ie. chat logs, phone records), all they need is proof of meeting in the past 2 years (boarding passes, passport stamps, maybe some receipts and photos). However, when dealing with Morocco, it's probably best to send to much rather than too little. Any additional info you want to send, such as a letter, will be accepted and forwarded on to Casa. It's not something they will pay attention to at the USCIS level, but Casa will look at it.

Thanks for quick answer. Where can I find exactly what I need him to send me now? Regarding the applications, I tried to download from INS site so I can email to him and then have him email back so I can check before printing but my computer says I cannot save them to my computer. What can I do? I thought I should check them.

You need to answer this question... It is a requirement that when you file your petition, you must be free to marry....
In your situation, on the filing date of the petition (if you do this before the 6 mos. period).... Are you free to marry (anywhere in the world)?

So what happens if I go ahead and send ahead of when they want me to send? Will the reject? Will I have to double pay app. fee (next time too), will I have to redo everything? As I said the INS person thought it would be okay, that they only look at divorce decree.

Who knows if they will reject it.... I suppose they would have to have knowledge of NE law, but NE is not the only state with a 6-month "cooling off" period after a divorce.
If they do reject then you would indeed pay again when you resubmit....

Be sure to have your fiance ask for American style visa photos- that way he will get the correct size. We had the photos done in Morocco and asked for passpost photos so they were smaller than ours. We sent those in, however and never had a problem.

Take a look at the I-129F. #16 is the name and address of the beneficiary written in his/her native alphabet. Is this what you mean?

Maybe what they are speaking of is that on the I-129f, it requests the beneficiary's address to be written in there native alphabet if it is different from the roman alphabet.

I know I don't need this info right NOW but he won the visa lottery once. Would it be helpful or hurtful to include this info including his letter of selection? I suppose he didn't come because of money, his parents, ties there, etc.

Yes, you will need four ORIGINALLY SIGNED G-325a (do not sign one and make three photocopies)

just a tip...sometimes its best to sign in blue ink. ive heard of them not being able to determine an origional from a copy if its done in black.

He needs 2 photos for your submission. He will need more later when it gets to Morocco.
To save time, he can download the I-129 fillout his address and name in arabic and send it to you to complete. Or you can write it in Arabic yourself or have a friend who can write in Arabic do it for you. He can also compelte the bio sheet online- you type the first page and it automactically completes all four pages. He then prints it and sends it with everything. Saves time of you sending it to Morocco.
Regarding the lottery. I know on the forms for the consulate interview they ask if he has every applied or received a visa. I don't remember howing to give this information for the first submission to USCIS. Answer honestly, they will have a record of it anyway.

What about this idea regarding my 6 mo. waiting period? --
We postdate everything (except signatures?) to reflect a date after my waiting period is up but still send it in ASAP to avoid the increase in fee?
Just one copy of the I-129?

If your divorce decree shows it is a final decree with no stipulation written on the document itself that the final date is 6 months or whatever the law says, then I say send it in. USCIS is looking for evidene that the divorce has been finalized and your divorce papers shoudl show the final date. Go by that date.

the i-129f is prepared by the petitioner. there isn't a place for the beneficiary to sign it, just the petitioner.

block 16 is where you put his name and address in his native language. no line for him to sign on the i-129f. refer to my previously listed link for the vj example form.

On the I-129 I could find no number on my birth certificate, so just put location issued (place of birth), is that okay?
at bottom of bio it says be sure and put name and alien registration number in this box, does he fill that out too? I don't think he has a number yet.

I am not sure what number on your birth certificate you are looking for? Maybe you are confusing the naturalized citizen number? native orn citizen won't have one.
Write none on alien number for him. He will be assigned one later.

yes! Can he fill it out online? Maybe you can chat while he types in the answers? then he acan print, send and sign? BUT no problem with you completing the form. I did and just had my husband sign where I told him

I have last year's model Dell here at home. I can open both forms and save the I-129 but cannot save the bio form, wanted to try to fill some of it in for him before emailing. I have reader 7.0

some of the forms you can fill in but can't save, others you can both fill in and save. trial and error is about the only way to find out. you can look at some of the available forms on vj or try the uscis site.
