Full Version: What if the USC has a criminal record ...

Just wondering if any of my fellow Canadians can answer that question. My fiance was not a good boy in his younger years (half a lifetime ago) and he is not allowed into Canada because of his record .He was allowed to come here to recouperate from his surgery and he has paid the Canadian Government many a dollar for them to grant him access (which we have been waiting forever for .. imagine that .. waiting on a government agency). It's been weighing on my mind knowing that my interview is up and coming and they may ask me why I always go there instead of alternating visits. We answered the questions truthfully on the I129f as they were not crimes of moral turpitude. Can anyone share with me some words of wisdom that may ease my mind?

They do run background checks on the USC but I believe it is more in accordance to the Adam Walsh law (crimes involving children) or IMBRA and those checks are done at the USCIS level which you're past now. I don't think that it would have any bearing on your interview since you're the applicant and you have no record. I doubt they'd ask you anything about his past. I think (someone correct me if I'm wrong), even if he did commit CIMT (which he didn't), the IMBRA law just states that you, as the foreign fiance, needs to be informed about it.

At my interview in Vancouver, they didn't ask me who visited who or why.

That's right. The background on the petitioner's record is done during the filing of the I-129F, and it's just the Walsh stuff and the IMBRA stuff. And as near as anyone can tell, the U.S. citizen having an IMBRA-related conviction doesn't hold up the visa. All it means is that the consulate will ensure that you know of his past if he'd say, been convicted of domestic violence.

So relax. smile.gif They're not going to care who visited whom. And you're not the one with the past. He is, and he's American, so he's already our problem, so to speak. wink.gif

Hi Lynamon. I don't think it will matter to them, as was previously stated he's already a US Citizen and you're the person seeking addmittance into the Country.
I made 4 visits to Lorry they didn't ask why she didn't visit me in Canada Actually all they were interested in was the meeting in person part I guess.

Canada is much more hung up on the crim record thing than USC, I believe. I was simply honest about my criminal record and it was long ago and not serious enough to cause me any trouble getting my K1. However I have heard horror stories from US , Mexican and European citizens denied access to Canada even for business travel due to admitting to minor records.

Thank you so much for the replies .. It's a relief to clarify with others opinions what I was assuming to begin with but couldn't be 100% sure ... now on to the next worry lmao (cause laughing is much better for you than crying smile.gif) .. oh I so can't wait for this all to be behind me smile.gif

Lynette, your next worry shouldn't be more than when to leave for Montreal since two weeks from right now 1:11 p.m. your interview will be over and you will be asking where is the passport already.
