Full Version: I-130 with I-601....when should I file for child?

ok I am going to be filing the I-130 soon for my husband. He will require a I-601 due to EWI over 1 year. I am also filing for his children who have never been to the US and are minors. Should I file all together? My concern is that the children will be approved sooner than my husband and they will not want to stay with me alone without him because they have never met me. They have talked to me over the phone, but they are only 7 and 9. I don't want then to be nervous and not want to be here if the process for my husband is going to take longer due to the waiver. This will all happen in CDJ. Anyone have experience with this?

I don't know about the paperwork for I-130s for children. But the 601 will be filed after the denial at the interview - you make an infopass appointment for waiver submission once you know the interview date. Adjudication takes about 1 day currently with the pilot program. So I doubt there will any issue with timing.
