6 months before we got married, chris moved in with me here in Brasil using a tourist visa. He is a software engineer and during the time that he was here, he was working via remote acess to his company back in Chicago.

I am affraid that when they ask about money, making a living, etc, it might be an issue that he was making a living for us while being in Brasil with a tourist visa.

I suppose that the law is to forbit tourists from taking citizens' job vacancies, and to forbid tourists from growing roots in a country without having an adequate visa. This, of course, does not apply to his case, but unfortunatelly, the law hasn't been modernized yet to approach this subject.

I don't think that he has done anything wrong. I base that on a similar example: if your profession is writer, and you go to a country with a tourist visa, you can't write there? Even if you are selling your work in your country of origin? I don't think so... in the last century it was very common for brazilian writers to go on trips to europe to get inspiration to write.
And if you think of it, Chris' case is the same. He is a writer too... a writer of code smile.gif

So, do you think this could mess up our plans of getting a K-3 for me?

To answer your question... No it wont create any problems as long as he has sufficient income to support you and has filed his tax returns back in the US you guys should be fine.

thanks, lance, you bring me relief... we have barely started with this visa thing and I am very anxious about it

Absolutely no problem. First, this would not be illegal. Equate it to an international business trip. He didn't work for a Brazilian employer. He worked for a US employer.

Second and more important, he isn't going to be applying for a visa to enter the US. You are.
