Does anybody know if anything more can be done.

14 years ago in the UK I was stopped at a police checkpoint and a small bit a cannabis was found in the back seat of my car. So the police took the car, myself and a friend who was with me back to the police station, searched us and the car and found no more. The bit they found in the car was 0.06grams which is about the size of a match head. 6 months later the police raided my house and found I had a plant growing in my bedroom. To try and cut a long story short they took me to court but I had doctors back me up and wrote medical letters that it helped with severe pain I was going through. I wanted to plead not guilty bcause the drug act says "any drug not used for a medical purpose" anyway my attorney told me to plead guilty, which I did but after reading the letters from Doctors the magistrate gave me an "Absolute Discharge".
I thought this meant Absolutely Discharged but it didn't it means you are guilty but no futher action is going to be taken but it will go on your record.
I apllied for a Q2 Visa in 2001 and got it and movrd to the US, I got married in 2003 and we filed for change of Status. That is when I found out that this on my record is causing us unbelieveable stress. We have been fighting our case now for 3 years I haven't been able to leave the country in 4 years and now we are just mentally, physically and financially drained between hearing bits of possibly good news to been told you have no hope, running round trying to get congress men and senators to try and help (Who have tried to help by writing letters to the DHS) , to paying $1000s out in application and attorney fees.

The last time I was up for an interview the Interviewer told us to apply for a I-601 which we did but recently we got a check in the mail from the DHS for the I-601 fee which makes me think they didn't even process it (Which I found out on the web is the I-601 cannot be used on a "drugs conviction") but surely there has to be something in there about humanitarian rights????

Sorry for what you're going through, but WTF are you going on about "humanitarian rights"?

In the US suggested that we might have a chance fighting it as humanitarian groundsbecause when it he seen all the medical records to back up my case

I'm sure someone else will suggest this (I've seen this many times) so here we go. Attorney Laurel Scott (specialises in I-601 waivers) has an attorney attended free chat on Wednesdays at 11:00 a.m. central time.

Medicinal marijuana...hell, ALL marijuana...is illegal at the federal level in the USA; I don't think you'll get any joy there. To the US government, drug use is drug use.

Ask in the waiver forum; I think there are at least a few people there with a drug conviction who got a waiver.

why not just move back to the UK? Probably quicker and less stress.

Yes it would be less stress but my wife is an only child her parents are in their 70s Her father in late 70s and we would like to be there for them. Also he just found out a few weeks ago he has cancer
