Here in Arizona, an international drivers license is not valid. The local DMV issued Pao a drivers license but only made it valid until the I-94 expired. Even the DMV supervisor was vague about what we could do before the arrival of her green card in order to get her driving privelages extended.. any ideas on this?

Every state has different regulations as far as giving a DL to someone who is NOT a resident... the usual procedure is to have the license expire on the same day that the I-94 expires... however, some states such as FL (it even varies by offices within the same state) you are able to get a DL for 1 year with NOA1... after you get your green card, there shouldn't be any restrictions...

YEP, they will extend driving privileges if you show them an EAD card, so if you applied for EAD, take that whe you get it to the DMV and get the license extended, or wait for green-card and use that.
Many states determine driving privlages by legal presence, EAD, or Green Card are what they look at for legal presence, and set expiration of the license to that of the legal presence expiration.

You might have some luck if you take the NOA for your I-485 - Ohio seems to be ok with issuing licences (I only got a learner's permit/state ID, as I can't drive, but I think their rules are the same regardless!) for K-1s who can show 'an I-797' to prove their 'pending adjustment' status - and that's the NOA. In fact, they wouldn't give me a state ID card until I had the NOA, but I went in last week and got it, and they've given me an expiry date of next May. I'm pretty sure the rules were exactly the same for driver's licences too - so it might be worth taking the NOA in if you don't have EAD yet...?

I wasn't allowed to receive an Oklahoma DL until I showed my PR card, the NOA1 for AOS was not acceptable. Others were allowed after showing their EAD card and they received a DL that was valid as long as the EAD was valid. You could always try going in with the EAD and see what they say.

Yepp, my EAD saved me too. But when I went to the DMV, they were clueless too, I had to insist that I read it on the Louisiana DMV website and made them look into it. After long debates, they finally got it figured out and now I have my DL!!

Arizon DMV accepts the following as proof to get a DL:
* Passport with Visa and I-94
* Resident Alien Card
* EAD card
They don't accept NOA1 as far as I can tell. So it looks like you'll either have to wait for an EAD or Green Card.

When my husband first applied for his driver's license in Phoenix, they too said it would expire when the I-94 expired. I was told however to take NOA1 for an extension up to one year. We decided to wait until he received his EAD and they extended it for a period of one year. Once he received his greencard, they issued another one with a 2 year expiration...just like the Conditional card.
As for the international driver's license, they will honor it IF the person is not employed, does not have children in school and is NOT a permanent resident. We were informed that Arizona will honor them only when those conditions are met.

Not exactly. Andre's driver's license is only a 2 year license......expires same day as his 2 year green card. I would think after the 10 year green card is issued, there wouldn't be any restrictions.

Without that NOA the license would only be valid for the 90 days that are written on his I-94.

At our interview, we were told th at there is a program called "SAVE" that the DMV can use to verify that AOS documents have been filed/pending. According to the person who conducted our interview, persons who have applied for AOS are eligible for a driver's license.
We didn't have to use the program because my husband's EAD card came in the mail a couple days before we went to the DMV.

They were wrong, basically. Each state has its own rules for who can get a DL. Most will require some form of paper proof. If you can't meet that, you're out of luck, and SAVE will not help you.

In Pennsylvania, they accept foreign drivers license for one year.
P.S. I just wonder, what does tourists and people who does business somewhere. They don't get from point A to pint B? These rules isn't hospitable, and however says USA regulations in general in international area, seems each state is his own republic on itself. Maybe its because in USA is so weird and interesting insurances. Who knows. If I look in EU drivers license's, it says, that its international, and in country list there is USA too, and its made by treaties between countries, what actually doesn't work in some states in reality.

In Tucson I have written confirmation from the DMV here that you can bring your NOA1 for adjustment of status and get it extended. When I went in last week to the centre at Stocker Drive, in East Tucson, the lady there knew everything about the K1 visa and she told me that when I get my driving license and my I-94 has expired, just bring the NOA1 (she knew what it was!) and they will extend it. So you definatly can extend the driving license whilst waiting for the greencard.

Hi there,
I need some advise about DL... I live in California Los Angeles, the DL office did'nt give me the DL, they asked me my SSN (who is pending, they must verify my imm status and it take 4 weeks) I showed the proof and I my EAD received yesterday (finally), but they refused it... Must wait my SSN ! very weird isn't ? I can work but without DL I can't drive (my job is pharmaceutical sales rep) ... thanks for your help.... have a great week end...

In NJ they didn't give me the license until I got my EAD (it took 7 months!!!).
And after 3 years having my NJ license (I am removing conditions right now) I almost lose it because my 2years GC is expired.
I got saved because I think they mistook my extension letter with the letter that the regular 10 years GC get nowadays when they file for the renewal.... and since they had never seen any before they let me pass...
I have alread had 3 licenses in 3 years and I am getting ready for the 4th one...
1st license with EAD valid for 1 year
2nd license with 2 yrs GC, valid for 2 years
3rd license (last month) with 2 ys GC expired and extension letter valid for 1 yr.
4rd license I hope really soon when my 10 yrs GC arrives. I hope next month.
Isn't it ridiculous?

Hi Bill, I did not read any rule that says drivers licenses for visa holders valid only until I94 expires. What I found out for Mira is, She can apply for an instructional license with 2 forms of ID ( passport and SSN) the instructional license is good for 12 months. Of course the driver has to be accompanied by a full license driver over 21. You might want to ask sheriff Uhling he may know more. Heh how does Pao like Tucson? Mira loves it here!!

When Pao got her learners permit, it had an expiration date 90 days from the date of her I-94 - once she passed her tests, her drivers license had the same expiration date. You might want to look at the actual permit Mira received and look at the expiration date. I'm hoping when we get the NOA for AOS we can get her license extended.
Pao and her 8 year old daughter, Wynne, both like Tucson and have been doing very well here.
