Hello Everyone,

I've entered on a K-1 Visa which expires in August. We were married this weekend. I applied and was granted a driver's license from New york State. However it expires in August when my K-1 expires... How do i get it renewed if i'm in the AOS process and have no proof of residency at that point? I realize every state is different, but any help from New york State would be appreciated. I just bought a vehicle and i'd hate to leave it parked in the driveway for a year while we wait for the green card.

I would like to know if anyone has advise from Virginia as I will be going there and get an international driving licence from South Africa valid for a year. Will I be able to use that???

You need to have 6 points of identity to renew a license, and an EAD is a valid 3 points. If you have your EAD at that point, you could use that, but without an EAD or green card (or stamp) it's going to be near impossible to show enough points of identity to get the license. An expired K1 won't work, and NOAs appear nowhere on the list for anyone.

And from experience, NYS tends to be very strict and follow the guidelines to the T. Here in FL, a lot is left up to the discretion of the HSMV officer. (Like with my husband - he's not supposed to be able to get his license with an expired passport, expired I-94, and NOAs, but they issued it to him anyway.) I wouldn't count on getting that lucky in NY so the car may be sitting in the driveway until you get the documentation you need ... or drive without a license, which I certainly wouldn't recommend.

Hey, I just wanted to let you know that my husband got an ID card at a NYS DMV that says "Temporary Visitor" and expires 4-5-08 (1 year after the date we went there). The employees told us that without an I-94 or Green card that says he can stay for at least a year he can't get a card. However, we spoke with the supervisor and showed her our marriage license and she gave us the card for 1 year. We brought my husbands passport, SS card and birthcertificate. So maybe you can show them your marriage license.
