Does anyone know, with the new AOS fee being a "package" with EAD and AP, do we have a choice NOT to apply (and PAY) for AP? Thanks. Milena.

Yes, even though the fees are a part of the package, you must still fill out the form to receive the benefit

Not sure I understand. Even if we DON'T want AP we have to apply for it? I didn't see the prices broken down on the USCIS pdf...

No, you do not have to apply for it, but if you decide at a later date you want it, it is paid for and all you have to do is fill in the form and wait.

I think maybe what milenka is asking is if there is no need for AP do they have to choose the "package option"? I may be way off base here - but thats how I read it. If thats the question - you pay one fee and all benefits come included. One fee/application all interim benefits while waiting for AOS to be adjudicated.

Yes, lal_brandow, that is what I meant, I was wondering if there is an option to just pay for EAD and I-485, and not for AP, since we don't want it? So, is it possible? Thanks for the information.

If this is the case, that is great. So how come on the list of new fees, they are all seperate?

Because if you file before July 29, 2007, and your interims expire before your greencard is issued, you will have to pay the new fee to renew them.

Doesn't it take up to two years to get your green card? So we'll have to pay twice?

Not necessarily. My husband's green card was approved in 9 months. Some have waited that long, some much less than what we waited. Pay twice how...you mean if you apply before July 29th? The only thing you would pay twice for is EAD and AP IF the green card isn't approved before the expiry date of the aforementioned documents. From what I understand, if filed on the 30th or after, the interim benefits are good until the green card is approved, however long that takes.

JoeCanuk,

And because there are people other than K-visa people adjusting status who might need to apply for advance parole or employment authorization benefits. The universe is bigger than our small corner of it.
