Full Version: FEES FOR CHILDREN UNDER 5

I am currently doing a i130 for my wife. I listed her son on the form but didnt see anyithing about extra fees for the the child. Does anyone have any info on that? When we do AOS is the fee seperate for the child or is everything included in the one fee?

The new fees for I-485 Adjustment Of Status states: If under 14 and -

filing with the I-485 applicationof one at least one parent: $600

not filing with the I-485 applicationof one at least one parent: $930

If you really need to submit an I-130 for her, then you may need to submit one for her son as well.

Isnt the i130 the correct way to do it.? There is a part on the i130 C17 that says to list all children of spouse. So I was thinking that the child can come on the same visa? Am I wrong? There has to be others here that have married someone with kids and brought them back as well??

The information you make available is a bit confusing. You show a visa classification of K1, your timeline is for a K1, yet you write about your wife and are posting in the K3 forum.

A K1 will normally have no need for an I-130 petition.

If you have married and are now working on a K3 for your wife, rather than a K1, then the child will need a K4 visa to come to the USA and an approved I-130 petition to adjust status afterwards. The child will not need an I-129f petition to apply for the visa, the I-129f petition for his mother will allow that.

Listing the child on a parent's I-130 does not result in the child having a visa.

Please tell us what you have in mind as a visa process for entry to the USA. Is it CR1 for your wife and CR2 for the child? Is it K3 for the wife and K4 for the child?

In any event, the child will need its own I-130, either now or at the time of status adjustment. It's a lot less expensive to file it now than after July 30th.

Please fix your timeline. Your "wife" cannot come here on a K1 visa, as indicated in your timeline.

With one possible exception the fees will be duplicated. Please indicate the preferred visa path.
