Dear All,

I need to take contact with someone who filled a "limited filing" at the embassy in Paris concerning the CR1 or IR1.

I need to know if the I130 is approved the same day you request it at the embassy.

In fact my case is complicated as we already sent a I130 in VSC for a K3 visa, in fact we were not aware of this procedure "Limited filing "( which was stopped at the beginning of this year).

I will try to do a Limited filing instead of my I130 on going in VSC ( I received I797 this week) in order to obtain the CR1.

So that others are clear, you plan to abandon the petition in Vermont before attempting direct filing in Paris, correct? It would be good to find out if that's even possible first.

I just did a search of the forum - it sounds like some consulates will accept the new petition without your wife cancelling the first one. You pay the fee again of course. You would say in the new I-130 that you've filed a I-130 before and give details on it. Contact the Paris consulate to ask if they would accept a I-130 with fee from a USC resident in France if she already has a pending petition for the same spouse in a US service center.
