my husband received his k3 visa but I someone asked me what papers were filed and I did not know what to tell the, I had filed the I130 on my own, but the lawyer filed the I129F, me and my hubby were already married in the US when both were filed, do you have to file both or could someone just file the I129F alone and they would still receive an apt letter to go to the mexican consulate? Basically what do you file to get a K3 visa on a already married couple when the spouse is EWI and the other is a US Citizen? Thanks for your help!

The K3 is for married couple.

EWI makes no difference until your visa is denied at the Consulate, you would then need to file a waiver, I 601.

You woud only need to go to the Mexican Consulate if you wanted to emmigrate to Mexico.
