Full Version: I didn't attach the I-797 NOA to I-129 K3 Visa...please help

I am applying for K3 visa. About a week after I send in the form I-130, I sent in the form I-129F but I did not attach the I-797 NOA to it. They approved both of the forms and send the I-129 tho NVC, then to Ho Chi Minh Consulate. My wife received the packet 3 for the K3 visa and she already turned it in too. We are waiting for the interview date. Since I did not attach the I-797 NOA for I-130 to the form I-129F, is there going to be a problem? Anyone has this happened to you, or any suggestion or advice would be greatly appreciated.....

I didn't have the NOA1 for the I 130 when we submitted the I 129F.

We had no problems at all.

please how you get your receipt number from your cashed check online.
How did you file for k3 without noa1,
please explain to me.

Hi Valentine, I did not get the receipt number from cashed check online. Before I send in my application, I went and talk to one of the USCIS(INS) agent, she told me to send in the I-130 first, then about a week after send in the I-129F, this way they would have my I-130 ready and won't be looking for it. I assumed that they must run on the same computer system, so they would know and that is what I did. I wish, I could have discovered this forum ealier then there won't be any concern now blush.gif After two-three months both of the form get approved, then they forward the I-129F to NVC then HMC consulate. We already turned in the packet 3 for about two months now, we should be receiving the interview date any time now, I hope.
Oh, one more thing, the I-130 still in the USCIS now, should I fill out the form I-824 to have it transfer to the NVC?

You should only file the I-824 if you want to disregard the K-3 visa and pursue the CR-1. This will cost you $200 to file and nobody knows for sure how long it will take to process, some folks have said it takes about 6 months or so.
