We need to remove hubby's conditions by October. Can we file immediately and beat the fee increase? What are the fees today?

I was thinking the same thing. My GC expires Oct 20th, so in effect I would be sending off paperwork around July 20th, which is 10 days before the new fees increase on July 30th (if I read it correctly).

You can only file once the 90 days window opens so if like me your 90 days does not start until after the fee increase the you have to pay the new fee rate.... I miss out by 13 days.....

The old fee at the moment is $275 including biometric, the new fee will be $545 or around that much.

That must suck for you. It's a fair old price hike that's for sure. I thought $275 was bad enough.
I best start gathering my info or I will end up paying the new fee.

We're gonna make it but only by a few days. The earliest we can file is 7/27. Will our fee be set by the postage date? What if they don't open it or post our payment until after the 31?

I believe they honor the postmark date... However, if it is postmarked the 30th, you'll need the new fee... The new fees are effective the 30th.. not after the 30th...

They should honor the postmark date. But I can tell you from personal experience that they don't always. Should that happen you can either try to fight them on principle or pay up and get the benefit that you want.

well, if you are going to mail it July 27, 2007- mail it by Express Mail- it will get there July 28
( eventhough its saturday-it will be in their box)

Or better yet, send it overnight on the 26th so it arrives there on the 27th... and I agree with Yodrak... even through they are supposed to honor the postmark date, there are some contract employees who don't get the memo and return it... Once it's returned and they request the updated fee.. it's an uphill battle to get them to see the error of their ways... At that point, it's better to just give up and pay the additional fee...

maybe I am misreading something but i don't think your green card expires on Oct 15th.... it says in your time line that your AOS interview was on the 25th and that you were approved on the 31st... so I am assuming your green card expires sometime between those two dates....

Yea I was guessing from memory on the 15th before. I checked the GC and it actually expires on October 25th. I took that date and subtracted 90 days to get July 27th as the first day to file. So my current plan is overnight it on the 26th to beat the fees...

Wow, I didn't even know that they plan to increase the fee...
I'm getting ready to send my papers off. Thank goodness it still gonna be the old fee.
But it's kind of weird, because when I was looking at the fee last week I was surprised that it is "kind of low"... well as I see not any more... They took care of that.
Don't get me wrong, I still think that $275 is lots of money, but knowing how much they usually charge for everything ...

This is sooo crazyyy. I am glad I read this, because I was starting to prepare to file the I-751 in September. I can't believe the fees are going to be so high.

If you have a friend at the post-office, ask him or her to postmark your letter now and
then mislay it for a few months to deliver it just after your 90-day window opens.

Well, we're getting married on Aug.18th so we miss the cut off date by a couple weeks. We were thinking of moving it up but I think this may be the best thing actually. Sure it's expensive but it would be even more expensive if your papers expire before your green card comes and you have to apply for them all over again. Better to just get it out of the way all in one shot up front.

under the new schedule if your AOS'ing there is no need to "file" for EAD & AP, it just comes as an attached interim benefit with the AOS. One check must be right.

I just wonder what would happen if you did file a few days before the 90 days?
Would they send it back?
Slap you on the wrist?
Deport you?

Maybe with other petitions like sending in the AOS application before the fee increase without all your documents they'd only RFE you and you'd save BIGTIME!

Right. Thanks. That's what I thought, I just wanted to check that someone else was reading it the same way I was. With our marriage being so close to the deadline, I'm figuring it's pretty unlikely that we'd beat the fee increase.
