[color="#0000FF"][/color] hey guys this is aquestion help needed for one of my friends he got married on dec 2006 and then she wanted to apply for ak-3 visa when his wife traveld back to us she started to apply for it but she sent the I-130 and the I-129f together she did not wait to the I-130 to be finished and then sent the I-129f well what happend is the i-130 and the I-129f both petition was approved the same day but the I-129f was forward to the american embassy at cairo before the I-130 and the I-130 still at the (nvc)for processing and he was recived aletter to inform his case is k-1 visa and the embassy needs him to send some forms back for his k-1 interview now he is married he is not afiance so now we need to change it into k-3 visa what he has to do??????????? help needed guyssssssssssss

they are married they have to cancel the k1 visa and continue with the spouse visa.

For the K3 you do not wait until the I-130 is *finished* before you send in the I-129F. It's somewhat normal for them both to get approved same day or within days of each other. Have your friend or his wife call the embassy to clear things up. It sounds like the embassy just got confused. If you're doing a K3, you do not have to do anything with the I-130...it just sits at the NVC. I'm sure it was just a mix up.
