I'm about ready to snap!

Vice Consul at the US Embassy in Ottawa (Canada) did some research on my case because my I-130 was approved but not my son's. We want to go to the K3 route.

Vermont wants my son's long form birth certificate, they said they sent an RFE on May 15th, but we haven't received it. I can't call the 1-800 for Vermont in Canada.

Anyways, I married my USC husband 6 years ago in the USA. We lived in Canada then ... but he has since accepted a position in Texas and is there.

Anything I can do as far as adjusting status in the US, say in July since I was married in the US?

Silly question ... but I'm becoming VERY impatient with the process.

I am the CDN, husband is the USC. We were married 6 years ago in the USA. We lived in Canada then ... but he has since accepted a position in Texas and has moved there (March 2007).

My son and I have filed I-130s and an I-129F. I would prefer to go the K3 route.

Where you married doesn't matter. You can't adjust status in the US because you don't have a K3 visa yet. Of course you can visit while you wait.

you'd only be eligible to adjust status if you had done it immediately after you married in the US and if you had stayed then. Married 6 years ago and living in Canada...sorry, no. sad.gif

I don't believe you're in the right forum...this is the Adjustment of Status forum...

I don't believe you're in the right forum...this is the Adjustment of Status forum...


She's asking if she can adjust status while visiting rather than applying for a visa (I think?)... and as far as I know, the answer to that would be 'no', regardless of how long you've been married or where you got married. smile.gif

and to expand on this answer... it would be really really dodgy given intent at entry and the fact that you already have cases pending.
