hello everyone
i filled up k3 application along with that 2 g325 A forums one filled by me and one filled by wife, i know it cost 170 $ in the start, i am submitting all supportive documents , like marriage license , 2 pictures proof of bonafied marriage and on going relationship proof.


Do i need to submit anything else along with the above things that Can any one please tell me it would be so appreicaited

well i did apply I130 and i was denied waiting for my NOIR , so i thought lets try K3 i dont know its good or bad idea but one lawyer told me apply for k3 and i will answer my NOIR and i am compling my all documents for that so i need to know what documets and forums do i need for k3 please let me know . i mean i have filled 129f forum along with g325A one by me and one by my wife along with that i am submiting date of birth certificates , passport 2 pictues with white background, emails phone records , i need to know anything else do i need to submit anything else with that please let me know

What about the marriage certificate? That's one of the most important documents.

i do have that , the list of documents i have for k3 is as follows

full filled I129f
2 set of g325a forums (one filled by me and one by my wife)
email records from both sides ( me and my wife)
phone records from both sides ( me and my wife)
marriage license ( in both langauges)
Date of birth certificate (me and my wife)
joint accounts
share property
500 pictures
1 passport photcopy
2 pictures with white background ( me and my wife both)

last but not least money order of 170 $ to chicago department of state

Any thing else do i need beside from that if yes please let me know i have all the above things but do i need anything else

one thing more my I130 is denied and i am waiting for NOIR from USCIS, appling for k3 is good idea or bad idea,i am applying for k3 coz there is always 50 50 chance in NOIR but i am doing my level best to get all documents done but still i dont want to waste any time and want to spend the same time on k3 .

please i will be waiting for good responsess

I dont know what NOIR is but in order to file for a k-3 you're required to submit the I-130 and then the I-129F along proof of filing the I-130 ( typically the NOA1) from the I-130.

7. One passport-type photo (see specification) of the foreign Spouse. Write the full name of the foreign Spouse on the back. Place in a plastic bag and label the bag "Photo of <Foreign Spouses Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.
8. Copy of the Birth certificate for the US Citizen (front and back) or a copy of ALL pages of the US Citizen's passport or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship.
9. Copy of the NOA1 from the I-130
10. A copy of your marriage certificate (If not in English then again get a translation)
11. In regards to Section C Question 2, if applicable provide certified copies of all court and police records showing the charges and dispositions for any specified conviction(s) (in accordance with the IMBRA). See section 9 of the I-129f instructions for more information.

notification of intent revoke , my I130 is deneid by embassy and i want to try k3 route along with waiting for NOIR FROM USCIS , IS IT LEGAL OR ILLEGAL any one can please tell me is it good route or bad route, please suggestions

well then I guess it begs the question; if they denied your CR-1 then whats to stop them from denying the k-3 as well?

Do you have the I130 NOA 1 from you filing? If you do, include that and file for your k3.

in my mind it's simple logic......if you're not eligible for an immigrant visa then how could you be eligible for the non-immigrant visa that is the prelude to the immigrant visa. Then again , I'm not a lawyer and I don't know your circumstances. I wouldn't dare venture into speculation and suggest anything to you. My knee-jerk is that some lawyers will say anything to get your money.......of course you can apply for a k-3 and of course they'll accept payment but that's not guarantee the k-3 can or would be issued.
Im sorry there isn't more to offer you Chaingang.......but we're pretty limited to what we know. My advice would be to speak to a reputable attorney and lay out the facts for them. Don't use the yellow pages......ask around... do your research.

thanks for ur answer , 2 lawyers suggested me to wait for NOIR (notification of intent revoke) and this is what exactly i was thinking when they were talking about k3 , this is absurd if my I130 is denied how come my k3 will be approved, i think i will wait for my NOIR and keep on compiling my documents , and i have 2 lawyers in my list and they seems to be nice one is heather poole and other is charles kuck both are very coperative and suggest me wait for NOIR and then we will answer them , so i think no k3 for me its waste of time for me best route NOIR and answer them.

You are missing the point - you need to submit a marriage certificate, not a marriage license. Two different things, the license documents that you are permitted to get married and the certificate documents that you have gotten married.

Submit the correct one.

I have a question for the forum. I am getting conflicting information from what my lawyer is telling me versus what the NVC representative is telling me. I received an email from CSC saying that my I-129F was sent to the NVC on the 23rd of May. From what I read on the FAQ and K3 guide in VJ, once the NVC receives the petition it is assigned a case number and then forwarded directly to the embassy. My lawyer is telling me that is not true. She said once the NVC assigns a case number, it is sent back to us with a packet that we have to complete (AOS) and send back to the NVC and then they forward to the embassy.

My situation has another twist. I have also filed for the I-130 and the NVC sent us the bar coded packet with the DS-230 and I-864 on 5/22 (we still havent received it).

My primary goal is to bring my wife here as quickly as possible since she is 5 months pregnant.

In my opinion, the K3 will be received in Venezuela before the I-130, but my lawyer thinks otherwise. If the information in the FAQ is correct that the NVC directly forward to the emabssy, the I-129 petition can be there as early as next week. Since we still havent received the I-130 packet yet, I am predicting it can take up to anotjer 4-6 weeks before the I-130 gets to Venezuela.

Can somebody help clarify? What would you guys do if you were in my situation?
