I read posts that FBI namecheck can cause long delays with AOS.

Can FBI namecheck cause long delays with DCF as well?

I do not know...in our case the name check was done in a month and a half...but it took a lot because of the shortage in people working to the petitions....

At the risk of sounding like a moron, at what point during the DCF process is the FBI namecheck done? It's something I've been trying to figure out from other people's posts and the guides but I'm stumped. wacko.gif

When you summited I-130, USCIS Office started to process it and first step they do is the applicant's FBI name check. They request the name checked in the States and they waiting for the files to arrive electronically. wink.gif

Okay, I'm a moron. I wasn't referring to MY (as USC) FBI namecheck but any namecheck for the foreign SO after the visa approval. Basically, what I'm getting at is if my UKC husband is approved at interview, what sort of post-interview checking might occur, if any, that might delay his visa being delivered?

And, yes, once again, I am officially a moron.

During my K-1 interview they took my biometrics and the officer commented that the visa would be approved once they receive the all-clear from the FBI fingerprint check. While we were standing there he looked at his monitor and said "Oh, that was quick. They've come back clear already." So.... I'm not aware of any namecheck following the visa interview (other than AOS).... just the biometrics.

Hmmmm, I do not think they do a name check for the foreign spouse.... at the interview the visa applicant will bring all the police records and I guess it is enough for them!?!?!?!

The reason why I'm obsessing over this point is that now that we're close to interview day (as are you Mayday -- day after tomorrow! Congrats!) I've been combing the consulate reviews for London. A couple of them mention people getting approved, pending last minute checks. What could these last minute checks be if your paperwork is all present and correct? blink.gif

fingerprint check is very different from namecheck. during our K1 process we had our fingerprints returned in 20 days, where as our AR (somewhat comparable to namecheck) took 7 months. Here we are again - in AOS, now pending in namecheck since November 2005.

I have no idea Elmcitymaven....I read all the time DCF cases in Germany and here is pretty easy: interview and visa in the mail in 3-5 days. .....

With the Adam Walch Act, the Embassy's abroad have to run a background checks on the Non US. Citizen in America. They do this via email and can get a response very quickly.

When I DCFed, the Embassy had already run the background check before the interview. We were approved and were able to pick up our visa the next day.

I think in some countries run the check after the interview. This is a brand new process and I am sure different countries are trying different procedures.
