Full Version: I-864 sent with I-130 petition

A long, long time ago, in a galaxy far away...... (last August 4, 2006, to be precise)

I sent in the I-130 petition for my wife. At that point, I had not discovered this wonderful site with all of the useful information contained therein, and along with all the other things for the I-130, sent in a filled I-864 form (and a supplementary I-864a from my mother) along with tax returns, etc. We just received the NOA-2 on our petition, and are hoping and praying to see things move as quickly as possible. I understand now that I likely sent in the I-864 erroneously, as it usually comes later in the process (once NVC generates a bill for it).

Now my question is this: Does anyone have a clue as to whether perhaps they may accept the I-864 forms which were sent in last year with the I-130 and just require the payment, or is it more likely that the ones we sent in earlier were discarded and we will need to send in fresh forms?

Any help in understanding on this would be *greatly* appreciated.

You need new forms because the tax returns on the form must be from the last 3 years .....

I would expect them to simply ignore the financial documents filed with the petition, since they are not needed by USCIS at this stage. You'll need to provide up to date documents when appropriate.

Many thanks for all responses on this. I had figured I'd likely need to do these again (and was aware that we now need only one year's tax returns), but I was hoping that perhaps the earlier sent forms would be sufficient. If anyone does have any experience with this which indicates other than tat I will have to file fresh I-864 forms, then please post to this right away if possible.

The information is in the guides. Yes, they will ignore the I-864 you sent with the petition and ask for another one at the appropriate time, with its accompanying fee. Count on it.
