Hey all- still waiting on the kids cards, congressman is getting back to me tomorrow (she is confident they will be here mid June) What do you think about the kids leaving the US and entering Canada without the cards, then I send the cards to the dad who has them for the summer to reenter? He wants them home as per seperation agreement- as do I, and it makes sense. The just ship the cards to them after they are gone? What do you think- to chancy? Or doable...any advice?

I wouldn't do it. What will you do if a card comes with a mistake? You'll have to wait again after filing the I-90 for correction.
What if they don't come in time? It wouldn't be the first time a confident congressman was wrong. Their confidence is not a guarantee.
Leaving the country without the card or AP abandons the petition--do you want that to be a possible problem on reentry?

My opinion is don't do it. no0pb.gif I have heard of someone on VJ doing this very thing and something went wrong and they are now stuck outside of the US. There is no guarantee that a CBP would have any mercy because they are children.

Also leaving the USA before AOS is approved without AP is considered to be an abandonment of the AOS application. Sure the facts here complicate that a little, but it still seems risky.

Perhaps you should have a consulatation with a lawyer or your local USCIS office to see if there is a way around this?
