is it true that our families and love ones will go through 15 to 20 years petition process before getting approved? i heard its the new law... that would be so sad. i will go home to the philippines and see my kids grow. i wont trade it for that visa. i hope its not true.

You need to be more clear on your status before you can get an answer to your question. Are you a legal permanent resident or a US citizen? Are you thinking of petitioning your spouse, children, siblings, parents?

I don't think there's anything new about this; people from the Philippines usually have a longer wait than people from almost any other country to immigrate to the US, unless they're the wife/minor child of a US citizen in which case they don't have to wait for a number to become available.

Since you're a permanent resident, your wife and children fall into the 2A preference category. According to the USCIS's latest visa bulletin, it looks like a five year wait for your wife and children, meaning if you apply now their apps will be processed in 2012.

I don't know if there's any way to get them to the US more quickly. Sorry.

15-20 years?!?! thats long.
Check the K3 Visa guidelines. An application for petitioning wife & children below 21 years old. It will only take 6-10 months processing (general average). Visa journey has the answers.

why don't you wait till when you are a USC which will be in about 3 years or so...then I think you wouldn't have to wait that long.. Please can anyone correct me if am wrong...that's just my 2cents good.gif

Second : Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, and any unused first preference numbers:

A. Spouses and Children: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;

B. Unmarried Sons and Daughters (21 years of age or older): 23% of the overall second preference limitation.

it dont take that long for kids.
but for brothers, sisters and parents it takes already over 12 years and counting nothing new
about that.

The visa bulletin is correct.
they are presently processing for 19922 applicants in your case.
You need to become a US Citizen, and then you can go thru the K3 process to get your family here.

Once you are a citizen, a priority date is immediately available without quotas for you to bring your wife and minor children. I should take less than a year.

The F2A category is for LPR petitioning for spouses and children and does have quotas.

As a LPR, you can petition for them under F2A and then upgrade the petition once you have acquired citizenship.

No, he doesn't need to become a USC to get his wife and minor children to the US; he can petition as an LPR, if what I read and posted is correct.

According to the link I posted but that nobody read, they're processing applications from 2002 in that preference category (2A); not 1992.

Yes they do have separate dates for the Philippines. I see you still didn't read the link. The separate date is April 8, 2002. That's the way it is!

I answered the OP's question several posts ago. Nobody paid any attention.


Well...I read it. It appears that you are correct!!!
That a 2a is processed sooner than a first preference.....makes no sense to me as I thought the lower (higher?) the preference, the longer the wait time.

Hey Hey Hey wait a second guys....so bottom line is...My kids will fall under the 1992 process if I petition them now (LPR status i have)??? or thats for the 21 above sons/daughters of LPR?

The priority dates for spouse and minor children of LPR in the Philippines is April 2002 -- about 5 years

so here's what i will do..file the petition (which i dont know what kind of form yet) and then wait a little bit and if i become USC, UPGRADE!

Yes, and also it will save some money eventually considering USCIS will raise the fee every year or every other year. :-)
Also, it will save some time for USCIS to process the the case. Then it will be sitting in NVC until the visa number is available for LPR spouse or children, or you becomes Citizen of USA.
