Hello everyone,

My wife came here on a CR1 visa or spouse visa. She has her greencard and it has been 2 years that she is in the US. Now she is 7 months pregnant and she wants to travel back home to Afghanistan. Can someone tell me if the baby is born there will she be able to come back with her easily. What are the rules of a my son born there. Will it give her problems to come back her later. thanks

If the baby is born abroad there is a process that is required to go through via the embassy. You will need to report this birth, prove that one parent is a USC and get the baby a passport before she can travel back. At least I think that is the process. Check the website of your embassy for the procedure.

As an aside, many airlines do not like to take passengers who are in advance stage of pregnancy... you might wish to check with the airline to see what if any restrictions they might impose.

If you are a US citizen, then you and your wife can take the baby to the US consulate in your country (if they are open again? ) and register the child's birth and get a consular report of birth. You can apply for a passport at the same time. As I understand you will both need to be there. Do the consular report of birth quickly, and for all practical purposes it is no different from having a birth certificate in the US. Hope this helps. Talk to a doctor before you make the trip, its generally not advisable to travel in late stages of pregnacy.

Did your wife and you file for I-751 to remove the condition for permanent resident card?
If not, you have to file it before 2 year period passed.

The other thing, I don't think it is wise idea to send your wife to Afghanistan, which is still war zone for me.
You never know what's going to happen when she is there.
Also, you can not predict the embassy business in those area, too.

If I were you, I rather convince her to wait for a year or two after new baby born.
