Hi Guys,

I got my K3 NOA2 on in mail last week. On the top half on the NOA2, it says that the K3 petition (I apologize if my terminology is incorrect) is valid from 4/30/2007 to 8/30/2007 (4 months).

My Question is this: Does the Guyana Consulate HAVE to issue an interview within this period? What happens if they don’t?

Thanks!

babybunny
That expiration date is basicly when you have to have the petition at the embassy.
dont worry about it. she dont have to have the interview By that date. ignore the date because, the petiton is at the embassy. more than likely since you have I-130 approval your k-3 will be cancelled.

oops. your petition should be headed to the embassy it dont take long.

No, Guyana Consulate does not have to issue an interview within the 4 months validity of your petition approval. If they don't, the Consular Officers routinely extend the validity of the petition approval. This is a non-issue at this point in the process, provided the visa is eventually issued at interview or overcome. It's the least of your worries.

Hate to disagree with a member with more experience, but my understanding is that the I-130 (CR-1) process is put on hold when the I-129 is approved at the same time (or before). DOS will assume that you want to proceed with the K-3 unless you tell them otherwise.

The CR1 was attained by NVC and the K3 was sent to GY...so i was told by an NVC Rep. Will i get any notices from Dept of State?

Although I'm sure your intentions are good, you are wrong. The OP's I-130 and I-129F were approved the same day. The current policy is to retain the I-130 at the service center (not NVC) and send the I-129F through NVC to the applicable Embassy or Consulate. Nothing is cancelled. They can pay $200 and file an I-824 asking for Consular Processing of the I-130/CR1 or do nothing and the K3 will proceed.

NVC has correctly informed the OP their petition has been forwarded to Guyana.
