I would like to know if anyone has the answer, what happens if you have a job, (EAD stamp at POE with K1 also have SS#) but file the EAD after the I-94 expires? Do you have to stop working untill the EAD paperwork is approved?
Kez/JWolf
Your work authorization ends on the same date as your I-94.... it does not begin again until your EAD that you filed for along with AOS is approved....

That is what I thought, this is not our situation, he is not working. I just wanted to know. Thanks!

Heather & Justice,

As a practical matter, it depends on what the employer tells you that you have to do. Although, you could take it upon yourself to stop working if you wish.

technically as long as your I-94 has not expired it is said that the K1 is temporarily work authorised. however, you would have to quit until the EAD comes through. Technically speaking the employer is supposed to complete an I-9 to show that he or she has hired you with the proper work authorisation. As Yodrak has said, it is up to the employer.

There are two kinds of employers: Those who require their employees to prove that they can legally work, and those who are breaking the law.

If you're able to find an employer willing to break the law yes. There are a lot of them out there after all, otherwise illegal aliens wouldn't be heading here in droves for work.
