Full Version: Infopass for my Husband

I went to an infopass appointment today regaring my husbands EAD application. He could not go because he was working. I had with me copies of all of our paperwork, passports, and marriage certificate, and I had a letter giving me power of attorney over his affairs. They would not accept any of this and refused to give me any information on the case. Is there any way to get information about my husbands case without him being there? They told me that they would only give information to a lawyer. How do people in the military/in the hospital etc get this kind of stuff done?

they won't see you because its not your *petition* its HIS application. very different. as far as military, etc. it wouldnt normally be the immigrant who is in the military. if you want someone other than your husband to handle the case - that would be a lawyer.

I understand that it's his application. Its just frustrating that there is no way to get info on his case. Its not like I'm just some random person on the street plus I had proof of his approval to act on his behalf. I know that my hospital will accept these kind of documents for one person to make decisions on behalf of another - I'm kind of surprised that the USCIS will not.

I'm a little confused....you're inquiring about your husbands EAD (employment authorisation, which according to your sig was rejected on 4/25), yet he cannot attend because he is working? Does he have a temporary EAD?
If the application for EAD was rejected, there was no explanation given w/ the official rejection letter? If not, maybe your husband can arrange his work schedule to take an extended lunch break to attend an infopass apointment to find out about his case. If that is not an option a lawyer should be able to help.

How can your husband be at work if he has no EAD??? as you have not updated your timeline We have no idea when he arrived in the US....

Thanks. He has the temp EAD stamp from when he entered as a K1 at JFK.

I posted in the other forum, but I mailed out the AOS, EAD, and AP packets together. We got the AOS and AP NOA1s on Monday. We also got a notice saying "Application Rejected" with the EAD check attached saying something about the payment being wrong, even though it was in the correct amount. The EAD package was not returned. The receipt number on the rejection notice was the same as the receipt number on the AOS NOA1. Also there was no indication anywhere on the notice which application was rejected, however I am assuming it was the EAD because that it the check that was attached. The whole thing is very strange and I am just curious if they can offer me any explanation. They officer was looking up stuff online and had kind of a confused look until he realized it was my husbands application. Then he literally threw the application back at me and told me to get out.

Our infopass is like 1.5 hours away only open during the hours my husband works. I'm just so frustrated cause for us every day of work counts.

Thanks for the advice, I found my answer, it seems that only "Attorneys in good standing of the bar" or "Accredited representatives" working for a "Recognized Organization" may "represent you before the USCIS."

so you re-sent the EAD package(even though you don't know why it was rejected) or "the EAD package was not returned" initially when they sent you the Application Rejected notice...? Your signature says that on 5/1 you resent the package to Chicago, yet in this above post you say the package was never returned to you?
If you have a NOA1 for AOS you can log into the USCIS website to see the status of your case....perhaps there is some information there regarding the EAD rejection, if the EAD rejection carries the same case # as your AOS. Or have you perhaps tried calling the phone number listed on your paper NOA1 for AOS?

christina has explained all of this before. no packaged received back for EAD, and there was no reason why it was rejected. so rather than fight it, she refiled. which is good logical sense.

you cannot find out info on a separate application by filing into an unrelated application.

I had made of copy of everything, so I reprinted the completed I-765 form, had my husband sign it (so it would be an original signature) and resent everything. When I log onto the website with the Receipt number only info about the AOS application comes up. I tried called and they did not know anything other than the fact that the AOS NOA and EAD rejection notices should not have had same receipt number.

I know at this point its refiled and Infopass probably will not help but I would just like to see if they can give my any information on what went wrong - just to let someone know that there was a problem. Its hard enough getting everything together, but to have packets rejected for no reason is really annoying.
