We received Packet 3 from Montreal las October (2006). We completed the medical, etc.. per the instructions.

We completed all of the necessary forms as well that we are required to bring to the interview, including I-134. For the three years prior 2005,2004,2003 my fiancee was at 125% of the poverty level and eligible as a financial sponsor.

However, she filed her taxes this past April for 2006 and does not qualify any longer (change of employment).

Basically, our paperwork was submitted sent to us last year (2006) and we returned the checklist in December of 2006. so 2005 was the last tax year we had. Since we haven't had our interview yet, I don't know if 2005 is sufficient or if they expect us to fill out a new I-134?

Do we need to find another sponsor and complete form I-864? IF so do we bring this form to the interview?

Or are we OK, since we submitted everything last year prior to this tax season?

I hope i'm being clear. Any help would be great...

How much short is she? There isnt a hard-fast rule that states the income level for the I-134 is 125 % of the poverty level. Ive read the amount is actually 100% although it's best to shoot for closer to the 125% mark to make AOS easier. If you do indeed require someone to act as your sponsor , they would be required to complete the I-134. What you might consider doing is getting yourself a joint sponsor as a backup, have them complete the I-134 including the supporting docs and also have your fiance complete one for herself listing her current income. On the day of your interview , present your fiance's I-134 but hold back the back up unless it becomes a requirement. See if they let your fiance's I-134 pass. Another thing; you can use assests to make up for any shortfall as well.

After getting the fiancé(e) visa, your fiancé(e) enters the U.S. through a U.S immigration port-of-entry. The U.S. immigration official gives your fiancé(e) instructions on what to do when he/she enters the United States. You must get married within 90 days of your fiancé(e)’s entry into the United States.

After marriage, your spouse must file Form I-485 Application to Register Permanent Residence or to Adjust Status with the USCIS office that serves the area where you live in the United States. You must fill out the Affidavit of Support, Form I-864, with the USCIS for your spouse's application to become a lawful permanent resident (LPR). i'm not sure if this is news to anyone else. i didn't know. i actually thought we all filled out the same financial papers. if you didn't either... heads up.

also to consider (besides assets. assets are taken as seriously): how many dependents does the applicant have? how much money is in the bank? how much is invested in a house/mortgage?

we did not have problems, but just to show i also worked, lol, i included MY paystubs and tax returns, etc. and to show i've never been a financial burden on the gov't and all that good stuff.
