I started the I130 process in Jan, but do to the long wait time I just filed my K-3. Just a quick question (which has probably been asked). Seeing that I just sent in my K-3, how will this affect out CR-1(I130) process?

What happens if the CR1(I130) process gets approved first?
What happens vice versa?

What do we do if she gets here on the K-3? do we just wait for the I130? does she have to travel back to India for the I130 interview?

You may soon wish you had posted first or even read some similar threads before you sent your I-129F. The idea of filing for K3 is to get your wife here faster. The time to do it is as soon as possible after filing your I-130. Most do it upon reciept of their NOA1 for the I-130 but it seems it is also possible to use other proof of filing and send them in at the same time.

An I-130 filed in January is likely to be approved any day. It is unclear under the new policy whether your I-130 is held at the service center because you "filed" for K3 or only because you have an "approved" I-129F for a K3. If you luck out and your approved I-130 is forwarded to NVC, you can use James' NVC shortcuts and get the I-130 moving pretty fast. If they hold it because you filed K3 or because your I-129F is approved first, then the K3 will get her here faster. All you lost was the time you delayed filing the K3.

I think it is more likely your I-130 approval will come any day. I hope it isn't held at the service center.

If she arrives on the K3 and the I-130 was not held at the service center, you have the choice of returning to interview for CR1 or adjusting status in the US. If not, you simply adjust status.

CR-1 process won't be changed because you filed I-129F. Let's see which one is approved first (most likely, it will be I-130), then you can think about options.

Thanks for the response guys, the reason i am applying so late is because in Jan. VSC didn't seem to be backed up and was on the ball. It's been 4 months since I got my NOA1 and it appears that many people who applied at the VSC prior still haven't gotten their NOA2.

It might seem that i will get my NOA2 in any day or with in the next 2 weeks because of historical data, but reecnt data proves other wise in my view. Any one elses thoughts? So i can maybe call ahead and stop the K-3 process

I would strongly caution you against stopping the K3 process. The attempt may hurt you more than leaving it alone.

No, you just filed your I-129f petition.

K3 is a visa, your wife will apply for it not you, and she can not apply for it unless and until your petition is approved.
