Full Version: K3 and I-824 for I-130

Is K3 processing cancelled if you file I-824 to forward I-130 to NVC?? Both my K3 (I-129) and I-130 got approved at the same time... and the K3 was automatically forwarded to the NVC while the I-130 asked for the I-824 (new policy)... I got a little confused and decided to send the $200 to forward the I-130 to the NVC... I figured I would take my chances and see which one gets done faster... But now I have a new worry, does the filing of the I-824 cancel the continued processing of my K3? ALso, it seems like this freakin I-824 needs approval and it's not something that happens immediately... So I'm really worried if my K3 gets cancelled and now I have to wait for this I-824 to process???

Please let me know if you have any more information.

As per my understanding, K3 processing is not cancelled if you file I-824. However, I think that I824 takes a really long time so most people find it worthless. You K3 visa would almost certainly be approved by the time any action is taken on I-824.

I haven't seen any hard data on how long it takes for action to be taken on an I-824 in this context but I suspect it to be pretty slow. However, filing and I-824 does not stop the K3 process. It is still possible to enter on a K3 and return to the native country for an IR or CR interview, just as before.

Thankss for your responses. I should have read these forums more carefully before I sent in another $200 for the useless I-824 ... I didn't realize this I-824 had a queue of it's own and people haven't seen a turnaround on it... what a rip off. Anyways, the point is to get my wife here asap so if she comes on K3 that's fine... how long does it typically take after NVC receives the K3 request and the interview date? 1-1.5 months? This is for India BTW.

Normally, the K3 should be faster.

And now, I think you have to wait for the I-824 being processed. So the CR1/IR1 will be much slower.

Forwarding your K-3 to the Embassy won't cancel I-130 here. I think, you meant I-864 instead of I-824.
