I got a notice of action on an old cancelled case because I am applying for an imbra waiver and had signed up for email notification on the old case. So last week i Get an email that my old case arrived at the california service center and was being reviewed/..

Does anyone have any idea what this means for them to be sending me notices on 2 year old cases when my case that is in is not even being touched? Does that mean possibly they are reviewing the old file to see if they will grant me the waiver?

By the way , I thinik the VERMONT filers are so lucky because those of us dealing with the other service centers seem to be waiting 4 times as long as them

Since you applied for an IMBRA waiver, of course they need your old file. After reviewing it, they will either grant the waiver or request additional information. You should expect a slight delay of course, but after the case has been received and reviewed then you will take your place in line. IMBRA has impacted a lot of people but those that have been applying for waivers seem to be getting the approvals.

Just wait a little while.

As far as the other centers, only Vermont and California are processing K-1's. The Texas and Nebraska centers are still forwarding their to California.

My situation is that I had a visa approved over a year ago and then me and the guy broke up in the middle of the process. I was DEVASTATED and went through the whole procedure of notifying both uscis and the embassy. My file had already left for the embassy. I had asked if other people had broken up before an interview had taken place and it just seemed so unfair to hold that petition against me when it was not my choice to leave or break up. I met someone else later that year and I fell in love and I am just so scared that I have become ensnared in the IMBRA laws. I am just really scared that even with the waiver request that I will get a big fat NO on my K1. I am terrified enough of the interview ( I was not before but after reading the boards I have become very scared) I had no idea that there was so much stacked against us...imbra laws..etc... consulates afraid of bad people...etc. The boards are both comforting and frightening to me. I have gotten touched 2 times in the last week and I got notice on the 12th that my old case was sent to the USCIS ( in a funny way... I had signed up for notification on the old case and the computer generated both an email and a letter dated 12 2005 with a current date of 2007. I consulted several attorneys about how much an imbra waiver would be and they wanted 2000 dollars just for the waiver and I was told by one attorney to expect a denial. Then other attorneys have told me that waivers are being granted and that the consulate was the place I had to be scared from not USCIS.. that if I had everything else in order and no criminal record for violent offenses that I most likely would be approved. I am just so scared I will get a turn down and the slowness of the case load in california really depresses me. Kind of like waiting in a big dark hole for something you know that will be a big NO. If I could get a fast no, then I could figure out what to do next.,, like wait for the approval to expire then refile or go a different route. In some ways, I wish I would have done my case differently but I knew it would be a long long long wait no matter what. i am so sad. Its been over 95 days with no notice of anything and just a couple of touches... the old notice freaked me out cause I thought it was from the first case and it wasnt until i did some checking that I realised when the old one was going back to USCIS that it was from the old case. Thats why I asked if anyone has gotten notices on old cases going back to service centers... cause it seemed so confusing

I enclosed an IMBRA waiver in my fiancee petition. They ignored it and sent me an intent to deny due to IMBRA and requested I send another waiver. This was sent out on April 23rd, 2007 and arrived April 28th, 2007. I promptly requested a waiver and sent it right back. Several very weird things. Usually with an intent to deny they give you 30 days. This notice only gave me till May 8th to submit a waiver and on the second page ( not the blue sheet) it gave me 30. But the blue sheet onlygave me 15 days to have my waiver there. I talked to an attorney today that is a friend of mine. He told me it could be one of 2 things. Either they saw the waiver and no matter what they arent going to give it to me and just sent this out basically to expedite denial due to imbra. Or they are just missing the waiver and if they didint have it, they would have approved it. It seems strange to me that the information is being requested so quickly.. not giving me anytime to get all kinds of things together. April send out intent to deny only giving me till May 8th to request a waiver.

What do you think?
Do I have a chance with this or did they basically already turn me down since I had the waiver request in my original petition/

They sent me an intent to deny based on IMBRA ( one fiiling in the last 2 years) and then asked me for a waiver and I had already enclosed one in the original petititon. they only gave me 15 days to respond. the lawyer told me this could mean that even with a waiver they are going to refuse me ( cause they already read the waiver I enclosed or that I didnt sign and date it properly with a heading saying WAIVER REQUEST. I dont know.. I am supposed to go to ALGERIA may 9th adn I will be there 2 weeks and I have to decide if we will get married and I will start an I 130 and start all over. But this time I will USE A LAWYER

they approved my waiver 5 days after I got married.. now I have to start a whole new visa RATSSSSSSSSS
