Full Version: Can I do a so called 'DCF' in Bangkok

I have been waiting for the K1 since January and have just found out about direct filing or at least sort of direct filing since the regions USCIS is in BKK. I am thinking of getting married here and switching since it may be faster. I have two questions that are as follows:

1. How much time does the process take from filing the I-130 to receiving the visa at the Bangkok Embassy?

2. Do I still qualify to file here since I am currently on a Tourist Visa? I was on a non-imm B visa from September 2002 to October 2006 which was when I graduated from my studies here. I have been on the Tourist Visa to stay here until I move back this coming summer when I start my PhD studies. Supposedly, you are supposed to be an expatriate and I am not sure if I qualify now that I am on a Tourist Visa. I do have evidence that I am working here (I know this is illegal here).

You might want to discuss your specific details with a US immigration attorney who is familiar with the USCIS in Bangkok. One such attorney who you might talk to is William F (Bill) White.
