Hello to everyone,

im going to have my interview this month (april) ...My confusion is: whould i tell the CO that my husband is with me here in the Philippines during the entire process? after our wedding he decided to stay here as he didnt want to be away from me ( so sweet of him)..

im afraid that ill be put on AR if ill tell the truth. (domicile issue) BUT if i will lie i may be in deep trouble...

YES i can just keep my mouth shut about this..but what if the CO will ask...when was the last time you see your husband? should i say after the wedding?? if they find out the truth would that be a ground for denial??? or worse fraud??

please help me..im so confused right now....

You need to know whether your husband has maintained domicile in the USA. Does he still have a mailing address? A bank account? An extended stay is not a problem as long as there is a domicile. He must have used a US address when he filed and on the I-864 and tax returns.

Being vague in this forum does not help you very much. If you mean by "domicile issue", that he hit you, my question would be how many times has this happened? My next question would be, do you want to spend the rest of your life being hit by him? Do you want him hitting your children like he hits you? I was raised in an abusive home, and let me tell you it is pure hell. I would not wish that on anyone.

I think the OP really meant domicile, like she said, not domestic abuse.

yes..his bank account is in the US..he still has his mailing address and yes he used US mailing address when he filed and even on I-864 and tax returns.

the only reason why he is here in the PI is because of me.( from wedding day till now..1 year and 2 months )

if i will tell the CO that my husband is in the US ..even thought the truth is he is here with me...and they find out that i lied ..can it do any harm to my visa processing.?? would that be a ground for them to put me on "Fraud"...

if i will tell them the truth that he is here since the wedding till the interview.they might ask him to go back to the US first before they grant me visa.( as the determination of domicile might be subjective in this kind of case)..all we want is be together through the entire process and travel together to the US..

please help me..

sorry to cause confusion..what i meant is the domicile requirement ...which says petitioner should maintained domicile in the US at the time of the interview.

Your husband has maintained domicile in the USA. There is no domicile problem. Tell the truth. Always tell the truth. If there was a domicile problem, you would want to solve it, not lie about it. Lying is something you never want to do in the visa process.

Be prepared to show bank statements and other proof the domicile has been maintained.

I'll just quote you from the Embassy website: "However, the petitioner must be domiciled or residing in the United States at the time the Filipino spouse has a visa interview." Love & Marriage ... and Migrating to the U.S.

It would be best to call them at the Immigrant Visa unit to be sure because this could be referring to someone who is stationed overseas in the military or temporarily has a job assignment in the P.I. from a U.S. employer (two "exceptions" who are considered "domiciled" even though not actually IN the U.S.). 02 528-6300 X5185

I'm not taking any chances and will be leaving the P.I. in two weeks which means probably a 4 or 5 month separation before she gets her visa.

and to show the domicile

thanks for your input guys...yes...i will just bring back statements..and other evidence on my interview to show that my husband has maintained his domicile in the US....
