Full Version: Need Advice: Waiting for K3 Visa for 30+ Months

Hello,

We applied for the K3 Visa in Nov 2004 and have been waiting since then for the approval. I used Holmes & Lolly and found them to be wonderful, however since Dec 2005 they informed me that the case is undergoing background checks as per what the NBC has told them when they check on the status. I checked the status on USCIS website and it shows that the I129F is "Case received and pending" and that it is at the NBC. However I then checked the processing times for the I-129F at the NBC and it shows Sept 2006. I am confused as to why my background check would take so long and neither me nor my wife have committed any crime before. Is it possible that this could be due to the fact that I am an American convert to Islam and my wife is from Pakistan? My wife and her family were in the US before but left on voluntary departure, could this also be a reason?

Holmes & Lolly suggested that I ask a senator to intercede but told me that if I choose this route then they themselves can no longer help me at all anymore according to the law.

All of this seems really strange to us... Any advice and answers would be helpful and greatly appreciated.

Did you apply for the K3 visa or submitted teh I-129F for to USCIS?
What is teh current status of your I-130?

The case is being handled by Holmes & Lolly. We filled out all of the necessary forms in 2004 for the K3 Visa and they handled the paperwork. Now we are at the point where it is held due to security checks so I am starting to think that there is really nothing we can do except to continue to be patient and wait.

but how long are you going to wait for......waiting for 3 years for an approval at the USCIS level is completely out of the normal processing times.....i don't know how you do it....being patient that is........

Will making an infopass appointment help out at all? Or will your lawyers have a problem with that as well? I'm just wondering... huh.gif

That's what I was going to say. Clearly, the lawyers aren't doing anything, and you should ask your congressman to help.

Contact your congressman and see if they can help you http://www.congress.org/congressorg/home/ at this link it will give you the information on the person to contact. Also, you will need to sign a form giving them rights to inquire on your behalf and in most cases it can be downloaded from their webpages.
