ADMINISTRATIVE REVIEW
Ana had her Interview today on April 10 at 7:30AM as the first victim: I personally documented months of chats, e-mails, financial support, phone logs, etc which took me a number of hours to gather and print with color bindings with color photos. The Officer at Window #27, a black man, kept for review. He only asked to keep copies of my prior divorces and Affidavid of support. Ana was devastated at receiving the white slip.
Ana asked why A.R. but he would not say anything but he needed to review the documents.

Personally, I think that he was jealous of my wages and assets.

Maybe he was looking out for my best interests.

He just looked at the document and said "FRAUD,"

which Ana did not understand the meaning. There is a large age gap between us, I am rather financial well off compared to some people, and Ana wanted a Prenuptial to prove to everyone that she was not marrying for money.
HOW CAN THERE BE FRAUD? I had to laugh at Prenuptial Agreements, which are really worthless in the USA.
The black Officer at window #27 just told her that she would hear from the Embassy in two weeks. He did NOT return her passport and did NOT ask her to pay for the Delbros. Wondering is he plans to have another Interview or how will Ana get her passport returned to her?

Most folks do not know me, but look up my name on Federal Reporter, where I have sued the Government. I have done this than most people know just for fun and test cases. I hate to do this as very time consuming. But, maybe there is a good reason for the AR by the Officer at Window #27. Or, maybe this was payback for my past irritations: :whistle:LOL

I'm really sorry to know about the status of your visa interview resulting in an AR. Hopefully, this will not be prolonged and the USE will contact your beloved informing her of the approval. You may need to follow-up with them because as you know the government is not big on follow-up (unless it's about collecting money). Doc, your impressive portfolio should have been a benefit, but with the obvious age gap between you and your lovely fiancée, it maybe logical to rattle her cage to uncover the truth (not with an AR, of course). Nobody wants our American citizen’s potential manipulated by the sultry beauty and seductive women (or men). However, there may be other aspects about your past or her's that you have not disclosed that may shed some light into why the CO elected to further review your case. Or maybe the CO is simply an arse... Who knows?
I will continue to pray for a speedy resolution!

Sorry to hear about the outcome of the interview... Do you think it's something about big age difference? Now I'm concerned and worried because David and I have huge age gap. Although I was assured by others that it's not really a problem during the interview as long as you can prove that the relationship is genuine... Any thoughts on this everyone???

Edit to add this: Is it possible that a CO can deny a visa just because he woke up at the wrong side of the bed and having a bad day? It makes me wonder...

the CO cannot deny a visa but recommend it be return back to the states for denial..and yes, the CO has the authority to request more info. the guidelines are clear on this

im new here and trying to fish some new info as im getting nervous about my interview...
this post caught my eyes, and wondering over and over what could be the reason for putting you on AR, i looked on your page and noticed but wasn't sure, it was on your page you were married or what? but it says something like;

i was just curious because im having my upcoming interview in a few weeks from now, and age gap could also be scrutinized about our case which i really hope not im crossing fingers and praying until i walk out the embassy with flying colors.. i hope
So it could be it?? I don't know, maybe this ceremony wasn't legal.

DocMay -> I think It is better to be placed on AR rather than on FRAUD, since there's no waiver for fraud. There are some who were placed on Fraud /FPU and it took months before they release results. I have read of one that had undergone interrogation by the FPU. One did not undergo interrogation but FPU did some field investigations. I have a co-employee placed on FRAUD, he appealed, but since there's no waiver, he is "banned for life" to enter US.
Hopefully they will just check on the veracity of your documents and maybe do some field work investigations. You just need to be patient and calm in following-up your case and status at the USEM, since they have a tendency to pass you on to another unit (FPU to CO and etc..).
Mae -> there are a lot of possible reasons (or rather they can make a lot of possible reasons) why they can "delay" visa approval, not necessarily "deny" as there is only limited reasons to get "denial" like in the case of fraud, few medical problems as being potential to cause harm to self and to others, medical problems that may cause "liability", and a possible "terrorists". And since some visa categories have limits per year, this could also be a reason why they may delay or deny visa. Since the CO are the "adjucator", CO need to be convinced that applicant will not be a "liability", that the sponsor can support the applicant, that the relationship is genuine/bonafide, and that documents are complete and "true".

alot of people are put on AR. in my husbands case they put him on it cuz they needed to wait for something from the United States before they could issue the visa.
i hardly doubt he was jelous of your wages and assests so stop bragging. alot of people make good money and they are not denied. my husband is a doctor and he didnt get denied so that shoots ur theory.

I am sorry to hear of your AR. Keeping the passport is a good thing so maybe the visa will be issued in a couple of weeks. Maybe they are going to do a CENOMAR or maybe there was a name check issue. When Claudeth did her police report there was a name check problem but she got that straightened out quickly. There is a 32 year age difference between Claudeth and I and we didn't have any problems so would doubt that you would either. My finances were very good also so the only thing I can think of is what I stated above. Claudeth and I wish you the best of luck and hope your situation is resolved quickly.

If you observe, DocMay put a funny face next to the statement concerning his wages and assets, which would lead one to believe that he was not bragging. Just poking fun at the situation and venting at the same time. The man is on AR. Please let's cut him some slack... Even if he is loaded and announces it, why does it matter (rhetorical question)? There are plenty of folks on VJ that do very well for themselves. However, I truly do NOT believe the he was bragging.

i don't think its bragging, but simple frustration and trying to grasp at straws to make some logic out of what seems to be a illogical result. It's a difficult position to be in. I hope it gets resolved. The good news is that the CO did not refuse the visa outright which they could have done if they suspected fraud.

I guess I read this differently than you do. After dealing with Manila I can understand where he is coming from and isn't bragging about his income and assets as much as not being able to understand, after all he submitted, why he is on AR. At least give him a break until he says otherwise. Peace!

Sorry, if I offended anybody as it was my feelings of helplessness and love for court battles. LOL

He didn't smile though, but when he started tying up our documents I asked him whether I pass or not but he just told me that they still review our case which will take a couple of weeks or so. And so I asked him again, are there any documents that I am lacking? Or failed to submit? He told me he couldn't say this and utter a "fraud" thing which I didn't understand! Of course I know what fraud is but couldn't relate it in our case."""
I think that her Birth Certificate or NBI was not printed on the incorrect paper. She obtained her NBI while in Manila going to school and used her Manila address, where all the other documents had her home address in the Province.
ANYONE have any idea WHEN to expect an interview again if this Consulate Officer send her notice to come back for another Interview in a few weeks or so? The CO only marked one check on the document attached: Checked the space:
"WAIT UNTIL YOU HEAR FROM US" under last paragraph
"WHAT TO DO NEXT."

DocMay it sounds like they are doing a further investigation into your documents or background checks may not have been completed at the time of the interview. AR/AP is very common from where my husband comes from and if they keep a passport that is a very good sign. Security checks could take time and that is why they said to wait until they contact her again. Good luck and hope that all is cleared for you both shortly.

I still think you are ok seeing that they kept the passport. You might be on to something about the paper the birth certificate or police report was printed on but I would think they would give her a missing document hold rather than AR. Claudeth and I wish you the best of luck with this and hope it is a quick review and the visa is issued soon.

I can see most of the VJers here are on AR. I understand the frustration, even we prepare all the documents they need according to their specification they still have job to do and double check or cross reference the papers we submitted. Let's just be more patience on dealing this.
As long as our intentions are good then there is nothing to be afraid of. Just pray more for His grace and guidance.

I have been on A/R for 10 weeks at the NVC level. I have been reading everything I can about it. It can happen at the Embassy level or NVC with the Embassy the most common. Most of the A/R's seem to be in Muslim countries where it is common.
The impression I have is that it usually involves security checks. At the Embassy level it happens when the background and security checks are not complete. I have a feeling that is the case with yours.
One of the bad parts is you never know when it will end or how long it will take but often at the Embassy level it is as little as two weeks. Sometimes it can go on for a few months.
The best thing I can say is stay calm. It won't hurt to contact your congressman but they can not help a lot.

For a brighter side, at least they did not outright deny your visa application, because they can do an outright denial for Fraudulent cases.
You may or may not be asked for another interview, If they are resolved with their counter-checking of documents and field investigations. As i wrote earlier about 2 cases I know-> one was interrogated and the other was not and only have to wait until the FPU is done with their investigations. Both were granted visa after months of waiting. Hopefully they will just do background checks and your case would not end up being denied as what happened to my co-employee due to FRAUD, which is not his fault. My co-employee have a document prepared for him that he didn't know about (by an Attorney if I'm not mistaken, he doesn't really want to talk about it because he's still upset until now) and that caused his fraudulent case/papers and he's banned for life.
Just pray and keep following up your case. Call every 2 weeks if you can. If the FPU is satisfied with their investigations, soon, your fiance will have her visa. Good luck!

A friend got a confidential peek at my file in the Embassy: It does pay to know the right people. What a shock?
The C.O. will be writing me a letter in the next five days. WONDER IF THIS IS GOOD OR BAD NEWS?
Good news if only missing information in my application, or bad is he discovered something horrible in the past.
My Ukrainian ex-wife filed divorce in November 2003, two weeks after I got her U.S. Citizenship. Then, she threatened to put me in jail the rest of my life. We placed Restraining Orders on each other. After the divorce, I discovered that she has been caught with massive amounts of drugs, money laundering, possibly connected to organized crime in Russia/Ukraine, and other crimes. I heard from other sites that this would guarantee AR. Plus, she is allegedly working as an informant in Las Vegas now. She left me to become a CRIMINAL? WHAT A LOSER!
Has anyone heard of past marriages/ divorce/ Retraining Orders with former foreign spouse causing an AR?

Yes, the embassy/consulate must make sure that the prior marriage is legally terminated and that all the paperwork is on the up and up. AR is to review all documents and to investigate any information on divorces, deaths, etc.
The CO gave her a hard time maybe because you're not around in USembassy in manila?

NOW, I know what was the problem:1. My divorce decree had the wrong Social Security number for me: Easy to fix this with other documents.
2. I never had any domestic violence, but I filed a Restraining Order (R.O.) on my ex-wife from her threats;
She file one on me in revenge: Both of us consented to a R.O. with no guilt of wrong doing civilly or criminally. R.O. expired in Dec 2004
I did not see a place to check for any R.O. on the last page of the I-129F application
and there were no arrests or bad conduct as Judge did not rule on either of our allegations.
Problem:
I have to wait until Consulate Officer contacts me to submit the silly R.O.
OR will C.O. just deny petition and have to start over???? ......Appeal docket is over 18 months behind schedule:

The Officer was polite in explaining that our paper work was having it final review and we should be receiving a decision in several weeks.
2. Being a doubting Thomas, I called the U.S. Embassy – Manila (Not the silly $20.00 / call number)
If one is a Petitioner, he may call 011-63-2-528-6300 then 7 then prompted for extension 5185#
I was told that Lorraine would answer, but I spoke with Sandy. She was also very nice. She told me that the C.O. had received the requested documents from his government source on April 27: I guess this was from FBI or who ever: C.O. would be reviewing documents. Depending on his case load, he would be issuing a visa in several weeks but this depended on his case load. HOPE!
Problem was that I filed the I-129F Alien Fiancée Visa OMB No.1515-0001 (Rev. 05/23/06) where I had a consensual Restraining Order (R.O.) with no ruling by the Court on the allegations by either party. The form and instructions only asked for civil and criminal convictions with nothing about R.O. except for violations of a R.O. The revised form on 11/24/2006 asks for R.O. where victim was an adult or child. But, IMBRA & revised 11/24/2006 form stated that the consulate would disclose any R.O. to the beneficiary. I guess that IMBRA thinks all women/ children are victims. HOW SICK? I did get a clarification on my only R.O.: Judge ruled on 4/30/07 that there were no findings of abuse or stalking by the Respondent (ME) and the Judge made the same ruling on both of us on 12/11/03. Gee, I am the victim here.
Does anyone have an idea will our application be denied, sent back to the service Center or allow to send this consensual R.O. for review. The Court’s Order is available on the Internet. What a joke?

oh give me a break. how many times does the OP keep having to refer the CO as a black man.
The CO is doing their job. now its the OPs - next step is to find out the matter with the case and address the issues- drop the assumptions.

Well, I'm pretty sure that there won't be too many black CO's in the Manila embassy; actually maybe only this one. That in and of itself may be the easiest way to identify the individual (rather than by name) for other interviewee's at the embassy for past and future reference to similar AR's. The black Officer at window #27 just told her that she would hear from the Embassy in two weeks. He did NOT return her passport and did NOT ask her to pay for the Delbros. Wondering is he plans to have another Interview or how will Ana get her passport returned to her?

LIARS - NVC sent case to the consulate MNL2006845138 (I am not paranoid about my number)
12/12/06 - Manila received the case? NOTE: NVC and two groups in Embassy do not know???

Most folks do not know me, but look up my name on Federal Reporter, where I have sued the Government. I have done this than most people know just for fun and test cases. I hate to do this as very time consuming. But, maybe there is a good reason for the AR by the Officer at Window #27. Or, maybe this was payback for my past irritations: :whistle:LOL

I think it's for the best interest of you two. A friend of mine got into this ordeal too. And the AR is in 6 weeks, He's already got her a plane ticket, too bad she wont be here in time because of that new regulation. I think Southeast Asia happens to be high in fraudulent cases.

I think you will be just all right. USCIS just wanted to make sure both parties are safe. The Amerikano and the Filipina.
Americano immigration is highly structured for security reasons. And it applies literally to everything all across the board.

Hell DocMay. your fiancee and I had the same interview date(April 10, 2007) until now I haven't receive my visa too. I have also received a white paper and they said "wait until you hear from us". I was just wondering what happen to our papers. My fiancee had a divorce with his exwife before but he said that he had no criminal record or restraing order.
He was an Airforce in New Mexico before and he resigned last May 2006. Then last June 2006 we met in person here in Cebu he stayed here for 2 months then go back to US last August 2006. He got job at Las Vegas, Nevada then after 5 months he resign again he got a new job and now he is presently working in Arizona Air National Guard. When he filed the petition he put his address in Las Vegas, Nevada coz that was he stayed after he resign in the Airforce. When I recieved the DS 156 &157 forms I fill out his new information like his new cellphone number and new address which is now in Tucson, Arizona. The question here changing an address was a reason why am I on AR? because I put his new address? I heared that they will give exemption if the petittioner is in the military because they will deploy or move and base. Pls. advice me what to do with this situation. I hope we will hear May and I receive a good news soon. God bless us you and May

INTERESTING that you bring this up to me:
Legal? According to whose definition?
1. Of course this is not a lawful marriage according to US or Philippines, as these government want to be little gods.
2. Yes, this is a binding marriage according to the Holy Bible, but who is your god? Philippine or US government?
3. I would rather have a marriage license to violate with little penalty if I was a criminal
4. Violation of a promise/ vow to God has serious penalties.
5. If no license, the Philippines and US Government does not recognized any ceremony
My faith is in God of the Bible, governments have a history of causing more problems than solving in life.
It would be funny to have my case on AR of practice of my religious freedom, as there are major financial
Penaties to the USA if I could prove the the C.O. placed us on AR of announcing my religious Promise.
This was a PROMISE CEREMONY in Phi culture, if the government can require a license for marriage,
Will the government require a license to pray? I serious hope this will never be a reality!
If I am denies a visa for Ana based on our PROMISE TO GOD, then surely I count this as an honor to my GOD.

Changing of the address could have caused some attention, but the CO mostly looks at the woman.
According to senior officials at Immigrations, 50 to 75% of women from the Far East are committing marriage fraud.
Marriage FRAUD is a condition where a women submits to marriage in order to gain entry into the USA,
without going through the normal immigration process. Then, she divorces her husband, to have a better
job and working conditions. This is crazy as surviving alone here is very difficult without training skills.
This happened to my Ukrainian ex-wife who listen to bad people to gain wealth in divorce. God does

The CO thought that I filed a fraudulent visa application as he did not think that I was divorced. REALLY: How crazy does this sound as it is illegal to be married to more than one wife, plus violation of several immigration statutes. If a person cannot function in society, I guess that he can always get a job at USCIS. I was offended that anyone would suggest that I was saying anything racial: this was only for identification! I really do not know if he was a good, bad or competent person: Obviously, he saw the misunderstanding as an intelligent American: I am proud of him.

Hi Doc May!! Congratz!!! I got a noticed from the delbros too that they going to send my visa or passport within 1 to 2 days. I wonder how did you know that if it was an approaved visa? Because the Delbros didn't tell me that I was approaved they just said" DELBROS DELIEVERY!Delvry for case #MNL200684xxxxx starts tom upt to d next 2days! U MUST leave a valid ID & a signed authorization letter or a 1WK DELAY will ensue. Did your fiancee also receive a message like that from Delbros? I just wonder why it takes longer to send my visa, coz my friend's visa they got it after the next day after they check the website of delbros and She is from Cebu City and me too. My other friend is also from Cagayan which is part of the Mindanao. I just wonder if your fiance get her visa now. Again Congratz and God bless!!

Sorry to hear that you had delays, but Ana did not pay Delbros fee on leaving Embassy and nothing set up for her.
But, Delbros is very efficient operation. For deliveries in CDO expect at least 5 day delay per www.delbros.com (see FAQ). I hope that this information was helpful.

Hey Doc..Congratulations.
For us today is day 23, and still dont know why for us.
I hope to call the Visa line, and the embassy again, or pray our poiliticians who have been contacted weeks ago come thru some day. Guess all I can do is wait, and hope, and I would just be happy to know why..or so I hope.
